There is a debate whether or not a CA has permissible purpose in pulling your report. I'd argue yes but many more say no. Some have had success in removing inquiries and examples are everywhere here; you'd have to search. One recently posted that the same CA pulled monthly thereby really affecting their credit (not-PP IMO).

CAs DO NOT have PP In order to have PP you must have asked for credit or a job. If an employer pulls hard copy you MUST give him permission!

They can do a soft pull!

http://householdwatch.com/wp/2005/07/26/regarding-sherman-acquisition-collections-and-nafs

Message Edited by HappyDays on 01-23-2008 11:58 PM

A link I have found where TU is telling their customer to modify procedures.

http://dwd.wisconsin.gov/bcs/bulletins/2007/CSB07-30.pdf

Per research:

The "Credit Transaction" must be voluntary,

Credit Defined: Equal Credit Opportunity Act, 15 U.S.C. §1691a, as the “right granted by a creditor to a debtor to defer payment of debt or to incur debts and defer its payment or to purchase property or services and defer payment therefore.”

I CA must have a legal right to collect on the debt and the creation of the original debt MUST have been voluntary.

IMO-

So if you default on a CC or Loan and a CA has a legal right to collect on such debt- they would have PP. (Pintos does not apply) as this was a voluntary credit transaction.

ANYthing else- Library, medical, child support, any judgment, legal, etc would NOT.
