    <description>&lt;DIV&gt;I DV'd them and instead of answering correctly, they sent me a letter requesting I send them all the information I have on the account.&amp;nbsp; The burden is on them to prove it is your debt.&amp;nbsp; If they have not responded by 35 days, sent a copy of the letter, the CM and the GC to the CRA and ask that they delete it because Midland did not validate the debt.&amp;nbsp; If Midland keeps reporting they are in violation of the FCRA.&amp;nbsp; If the CRA verifies it after the 35 days, I believe they are also in violation.&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;I have a collection account that was opened about a year ago (way past 30 days).&amp;nbsp; I was ignorant&amp;nbsp;of what to do, but because&amp;nbsp;of this forum&amp;nbsp;I have since started to repair my credit.&amp;nbsp; The DOFD for the medical bill that was the cause of this collection was 10/99.&amp;nbsp; I DV'd Midland and disputed through all 3 CRAs as obsolete.&amp;nbsp; I got responses back that all three collections will remain on the account from the CRAs.&amp;nbsp;I'm not sure about their MOV.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;Now I got a letter back from Midland regarding the dispute.&amp;nbsp; They don't even mention the DV I sent.&amp;nbsp; They are asking me for the new information that I have that will aid them in clearing up any mistakes they may have made.&amp;nbsp; My question is, shouldn't they know when the DOFD is?&amp;nbsp; Why are they asking me to send them documentation?&amp;nbsp; I cannot get documentation because the hospital will not send it to me.&amp;nbsp; They will only give me verbal confirmation of the dates.&amp;nbsp; The hospital insists that Midland has all of my records.&amp;nbsp; If I'm past the 30 days to request verification, what do I do if they don't respond to my DV letter?&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;Also, on my TrueCredit&amp;nbsp;alerts Midland is showing as a new account twice in the past month for Experian.&amp;nbsp; Does this mean that they are reaging the account?&amp;nbsp; How do I fight that?&amp;nbsp; I don't really have enough money for a lawyer.&amp;nbsp; I just want it off my Credit report.&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;I dv'd them also they have duplicated my account.&amp;nbsp; I havent received anything from them yet.&amp;nbsp; How quickly did you receive your reponse?&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Also,&amp;nbsp; I think if they dont very the account after you dv them the must delete the account from your reports.&amp;nbsp; Keep reading on these boards and you will find out what other people have done.&lt;/DIV&gt;</description>

      <description>namron, do NOT supply them any information to them! They are fishing to help build a case against you!&lt;BR /&gt;&lt;BR /&gt;I would say DV them again, CMRRR and NO contact with them what so ever. Wait another 30 days and if no response, dispute with the CRA's who are reporting.&lt;BR /&gt;&lt;BR /&gt;I'm sure others will chime in with their recommendations today.</description>

      <description>&lt;DIV&gt;&lt;/DIV&gt;&lt;DIV&gt;IF Midland has NOT responded to your DV and it's been 30 days since they signed for it:&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Send follow up letter to Midland. In it, tell them they are in violations for continued collection activities and that includes reporting to the CRA's.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Send another dispute to CRA's. Enclose copies of DV to Midland, GC, CM receipt. Tell them Midland has refused to validate within the 30 day's allowed them. If this was c/o in 99, it is also past CRTP.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;And as Syl suggested Do not give Midland ANY info from you!!!&amp;nbsp; It sounds like Midland has re-aged and has nothing to go on to collect this from you.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;If this doesn't work, post back so you can work on what happens next...&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;ETA: IF this is a hospital bill, then all bet's may be out the window as far as SOL. But, CRTP is still in effect.       <description>&lt;DIV&gt;Okay.&amp;nbsp; They have 3 days until I reach the 30 day mark.&amp;nbsp; I was under the assumption though that I missed my true window of opportunity to request validation because I was informed of the collection a year ago.&amp;nbsp; I was just too ignorant to know what my rights were at the time.&amp;nbsp; Can I really still request that the collection be removed if they don't respond to my DV after the initial 30 days of collection?&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;I have had luck with filing complaints with the states attorney general .Also my brother sued Midland in small claims court, since they did not show up he won a jugement against them for their violations .$6000.00 . He did not collect yet, I am not sure how that will go, but at least he used that to get deletions on his credit reports .&lt;/DIV&gt;</description>

&lt;/DIV&gt;&lt;/BLOCKQUOTE&gt;Some states have laws in place where there is no SOL for medical debt with hospitals and other types of facilities (surgery centers and etc.). You could be sued as long as the debt is unpaid. This &lt;STRONG&gt;does not&lt;/STRONG&gt; include debt owed to physicians though.&lt;BR /&gt;
