Portfolio is trying to mess with me

I checked my credit report about 4 weeks ago and a debt with Portfolio that is still being shown as supposed to fall off in July 2008 said it had a recent payment of $38. I disputed it and it is now coming back as verified and that that amount is still a recent payment. What should I do?

Leave it alone and let it fall off? DV Portfolio? I feel like they are up to something but I am not sure what. I have not even spoken to these people and there is no way they could possibly prove that I have made any kind of a payment to them. Any ideas?

What's your state's SOL? They are trying to keep SOL alive. DV them. They have to send you copies of statements, payments, etc.

I incurred the debt in North Carolina and Illinois, I have paid nothing on this debt since 2001. I now live in Texas. So I guess any of these three states could be considered in using SOL. They are also reporting this as an installment account. I dont know if this makes a difference. It was a Sears Credit Card originally.

As long as this is considered an open account--the SOL would have long ago expired--in any of these states. Actually, the only SOL that they could even possibly get me on is written contract in Illinois, but I didnt stop paying until i hit NC--so.......

Why would it be a written contract. Even still, if DOFD is 2001, they are past SOL in all three states. I would DV them.

The slimeballs did the same thing to me. DV them. Send the letters to all 3 of their addresses/Corp names in VA. Deny making the payment, demand they provide proof of the 'payment'. File complaints with your AG and the VA AG, VA BBB.

mbush12, send the CA a DV CMRRR ate the same time file a complaint with your AG their AG and the FTC complaint that they changed the DOLA and verified it with the CRAs......keep copies of everything!!
