How do we find out if my DW was Served?

DW has a civil judgement on her CR that was filed in 2004. Funny thing is that we do not remember anyone sending her letters or signing anything. There is a Docket number that's on her credit report. Can this be used to determine if she got served properly?

We are trying to find out if she was served properly. What are our first steps?

Just contact the court and get copies (small fee)

Some places you can access this information online.

Once we get the copies, can we just file a Motion to Vacate while we are there? How would we know from these copies that she got served?

There should be a copy of certificate of service within documents concerning this case.

I had my DW call the local County Courthouse with the given Docket Number and the clerk said that this was for an eviction that took place in 2004. The problem is that we've never been evicted from anywhere!! This is not hers!! The name thats on file matches hers but we were married before 2004 and we lived in another address at the time of the eviction.

WTH? How in the world do I need to dispute this? Is this going to be difficult to remove?

You may have to consult with a local consumer attorney on this one. Tough Call !!

I would just dispute it-

"Wrong Mrs.theshadow12345 " Not mine.

If they verify SUE them.
