      <title>Creditor refusing to send DV???</title>

      <description>&lt;DIV&gt;&lt;/DIV&gt;&lt;DIV&gt;Recently I have been working very actively to improve my credit and clear up any negative items on my credit report.&amp;nbsp; I have a $52 collection from 2001, and went to the trouble to track down a phone number for the CA and request a statement for this debt.&amp;nbsp; This man calls today from the CA (if he gave me his name at all, I don't remember it after all the yelling he did) and asks me to pay with a check by phone right now, and I tell him I have not received a statement, but as soon as I can verify that the debt is valid, I will certainly make that payment.&amp;nbsp; He says he personally sent it out on April 9, 2007, and specifically remembers sending it to me.&amp;nbsp; I tell him again I did not receive it, what address was it sent to, he gives me that address, and so I ask if he can resend it.&amp;nbsp; At this point, he became very angry, and says its not his responsibility, if it wasn't delivered after he mailed it or if I threw it away because I was distracted by my kid crying&amp;nbsp;its my fault, not his.&amp;nbsp; My come back with why would I go to all this trouble to resolve a debt just to throw the bill away when I get it, and if he can validate the debt, I would be disputing it on my CR.&amp;nbsp; He says it has been validated, good-bye, and hangs up on me.&amp;nbsp; My question is, where do I go from here?&amp;nbsp; Is this sufficient to file a dispute?&amp;nbsp; The dept is in Arizona, I am in California, and haven't even lived in that city for more than 3 years.&amp;nbsp; I don't know what the delivery laws are here, but in AZ they are very lenient.&amp;nbsp; Any advice?&amp;nbsp; If this is a valid debt I will certainly pay it, but I don't have the money to throw into anything that isn't a valid debt against me.&amp;nbsp; Thanks.&lt;/DIV&gt;&lt;DIV&gt;Jennifer&lt;/DIV&gt;&lt;BR /&gt;&lt;BR /&gt;Message Edited by djactenaz on &lt;SPAN class="date_text"&gt;06-05-2007&lt;/SPAN&gt; &lt;SPAN class="time_text"&gt;10:23 AM&lt;/SPAN&gt;</description>

      <description>&lt;DIV&gt;Understand that paying it will not make it drop off your CRs and won't improve your scores any.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;SOL in California is 2 year for oral agreements, 4 years for everything else, and it's not lawful for an OC or CA to sue when they are beyond SOL.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Never attempt to validate with a CA over the phone. They lie. Much like the IRS and hormone crazed teens, they seek to screw everyone they meet.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Is the CA reporting on any of your CRs?&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;Yes, they are reporting on at least one of my CR, but I believe it is all 3.&amp;nbsp; It is a debt from 2001, and was first placed on my CR in 2004.&amp;nbsp; Also, this debt was supposedly incurred while I was living in AZ, but I'm not sure if that matters since I am now a CA resident.&amp;nbsp;&lt;/DIV&gt;</description>

Practically speaking, they always sue in one's state of residence. I don't believe California honors foreign judgments, but not positive.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;However, that's all academic. As Tuscani said, DV them.&lt;/DIV&gt;&lt;/DIV&gt;</description>
