Need quick hud supression

We tried to sell our house in 2012, bank of America could NOT produce a title, tried a short sale, surprisingly same efdect, no title no sale, we left the house in 2012, there were renters in the house in 2015 thru mid 2016, house sold august 2016.... fha office today siad we would have to wait till 05 03 2019 before we could get another fha loan. We had 2 repair shops, and were doing great till I had to stop working, applied for ss benefits, that took almost 5 years to get, by the time it was awarded though we pretty much lost EVERYTHING, its taken over 3 years, but credit is great again, loan company did a pre approval without checking this list...my name hits and for the past 3 days and number of calls to bank of America that claim ignorance over the entire deal and getting nowhere... was told this site migjt help..m here i am

Hi Sgabriel,

You left the house in 2012 & did what with it? You mentioned renters where in the house in 2015 through mid 2016 & that it sold in August of 2016. Who collected the rent & what type of sale was done in 2016?

We got a eviction notice and a notice of sherrif sale around august 1st.... a real estate broker friend told us it sold for 8000.00 but again bank of america couldn't produce a title, after a while it was being rented to simeone, not sure who or how or who the payment went too..... im not sure what mind of sale it was but it shows on realtor.com as being sold in august 2016 for 263k

You need to figure out when Bank Of America actually foreclosed on your old mortgage. You are not eligible for another FHA mortgage for 3 years from that date regardless of the CAIVRS issue.

FHA/HUD will only suppress CAIVRS if it can be shown that the lender did not follow FHA/HUD requirements/time lines for foreclosing & or filing the claim.

Zillow shows it was recorded as sold at auction for 8100 on 12 august 2012...... zillow has a complete sales and tax record 9111 Pittsburgh blvd fort Myers florida 33967

Ok, so if BoA forclosed on your mortgage back in 2012, you should qualify to have your info suppressed in the CAIVRS system. The fastest way to get that done is to contact your local congress person's office & get them involved.

Yeah thanks, not too sure that's going to help either, contacted Marco Rubio's office yesterday.... not heard from them yet either and the clock she is ticking, thanks though. A friend pulled up some record not sure which, showed BofA tried to get a title in 2012 and again in 2013 and 2014, tax records shows they paid taxes from 2012 till 2016

You need to be way more assertive/aggresive with Rubio's office to get them working on this for you. Keep calling until you get someone on the phone that will help you.

The other option is to request the suppression on your own.

Problem is he is a proud Vietnam veteran, who has been spat at, stepped on and now totally screwed by bank of america, he pulls himself up by his bootstraps one more **bleep** time, takes 5 years to fix his credit and get to the point where as he says, he is going to buy the house he will due in..... and all these **bleep** government agencies can say is, well check with the lender.... even after he gets prove of their mistakes, hell he had the house sold in 2012, and BOA could bot provide the buyer or lender a title because they had things so screwed up.

Now he tells me to drop it cause he is afraid because its a defaulted gov backex loan they will take away his va benefits and his social security benefits..... un real, and you cant make that **bleep** up... again everyone thanks for your help

Well I should have asked this sooner. Is uising his VA entitlement for a VA mortgage to buy this house?

Originally he wanted to go with a va loan about a year ago... his thought was that it had been 4 years cause they ask have you defaulted on a federal loan in the last 3 years, i guess that loan officer pulled that report didnt say why just said he couldn't qualify for a ca loan at that time. So its husy a fha loan.

VA will have a lower monthly payment than FHA & VA has a higher debt to income threshold than FHA does so if he qualifies for an FHA loan he should qualify for VA.

In addition to that, with the active CAIVRS hit, he does not qualify for FHA.

We qualified together, fha is now in the process of reviewing bank of America actions in a almost 4 year delay in filing, they said they would have a report within 48 hours.... who knows.

Ok so why do you think that you wouldn't qualify for VA together?
