      <title>Confused about Title issues re FHA</title>

      <description>I'm a non-borrowing spouse (or non-purchasing, as I've heard it both ways) and the loan itself will be only in DH's name.&lt;BR /&gt;&lt;BR /&gt;Does that mean that, since I'm not on the loan itself, I cannot be on the title or Deed of Trust? One moment I hear that's the case (and that it's an FHA guideline), the next, I hear it's total baloney and simply a lender guideline, and that FHA doesn't give a rat's patootie and only cares that I acknowledge that FHA holds the first lien on the property (or something to that effect).&lt;BR /&gt;&lt;BR /&gt;What I think confuses me the most is that our LO asked me, knowing that I was NOT on the loan itself, if I wanted to be on the title. I told her that I'd like the option, but that it wasn't necessary. When I asked the Title Company if I were to be on the Title (and they KNOW that we're FHA and the loan is solely in DH's name), she said she wasn't sure and that she would have to see what the docs from the lender stated.&lt;BR /&gt;&lt;BR /&gt;Since we've yet to receive our HUD settlement and we're closing Tuesday, I'm on pins and needles. DH and I want me on the title and we'd like to know what our "rights" are. We're even willing to kibosh this lender and ask the seller for another two weeks to resolve this with another lender.&lt;BR /&gt;&lt;BR /&gt;Does anyone know?? Anyone else go with an FHA loan with a non-borrowing spouse and were able to have that spouse on the title??????&lt;BR /&gt;&lt;BR /&gt;I live in a "Homestead State" so I know my rights are protected by state laws, but I'd like my name on the title if it's allowed by FHA ... I feel like I worked so d@mned hard to raise DH's credit that I kinda deserve to have my name on there!!</description>
