    <description>&lt;P&gt;They can't sue you for it. It's out of SOL, they had their time to collect. They could try and sue, but I could say they had two years to collect already, so it wouldn't cause a judgement or added charges to me. Since they know it's out of SOL, they think I will never worry about the old debt anymore, they lost their leverage on me. However, I still want to pay and use the leverage the debt is out of SOL and I merely want to "make good" on my debt to get a PFD.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;Hi-&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I started looking at my entry of ER Solutions again. I originally planned on ignoring it, then I wrote a PFD letter, when ignored, I thought about forgetting about it, now I have nothing to do at the moment, and want to do something productive. I sent a PFD to the address on my credit report after contacting Sprint and Sprint did confirm the account is with ER Solutions, and will not pull it back. The PFD was sent CMRRR, and I got the green card back with a stamped signature within a couple weeks. No response. Thing was, I've never received anything from this company. I was just trying to clean up my reports.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm getting desperate; there is only so much I can do on my reports, and want to make some progress...start and finish on one little project right now. I have a feeling they are going to get ready to sell the account to a new collection agency, as it's been sold once before; first Sprint had it, then AFNI, as soon as I contact AFNI, I find it was returned to Sprint. I contacted Sprint, they had sold it to ER Solutions and had no say in anything. Despite my pleading for wanting to pay Sprint in full to resolve the matter. They said their hands were tied. ER Solutions has never sent me anything, never contacted me, and last updated my credit report Nov 2009, after first reporting May 2009, according to my 5-1-10 Experian and Equifax reports.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;DOFD April 2006. Scheduled to remain on record until October 2013.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Any advice please on what to do next? I'm starting to get itching fingers and call, but don't want the repercussions of what "can" happen. I've sent a PFD, if they won't accept it, why won't they at least send me something? What would you all recommend my next step be? If they go ahead and sell it, I may not get a PFD- liking CA, and it will be a whole new entry, hit, etc.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm just looking to see what anyone would suggest I do to get them interested in communicating with me. lol Thank you much!&lt;/P&gt;</description>

      <description>&lt;P&gt;The CA, ER Solutions, is also probably getting a bit itchy.&lt;/P&gt;&lt;P&gt;&lt;BR /&gt;From what you have said, the OC not only sent the account for collectiion to the CA, but also sold the debt to the CA&lt;/P&gt;&lt;P&gt;it is a telecomm debt.&lt;/P&gt;&lt;P&gt;US Code Title 47, 415 limits the statute of limitations on all telecommunications related debts (telephone, cell phone, radio, etc) to two years. In fact, part (a) of this section reads as follows:&lt;BR /&gt;&lt;BR /&gt;(a) Recovery of charges by carrier&lt;BR /&gt;All actions at law by carriers for recovery of their lawful charges, or any part thereof, shall be begun within two years from the time the cause of action accrues, and not after.&lt;/P&gt;</description>

      <description>&lt;P&gt;omg that is good info&amp;nbsp; because just this week i had a collection co CBE GROUP&amp;nbsp; write a letter to me stating i owe 3,577.00 to verizon cell&lt;/P&gt;&lt;P&gt;with a date of disconnect 02/09&amp;nbsp;&amp;nbsp; which all is a lie-----i owed maybe a few hundred but not thousands and i last paid on the bill was&lt;/P&gt;&lt;P&gt;08/08---and i called and had it disconnected in oct 08 (financial reasons)&amp;nbsp; so when does the 2 year mark begin is it when i last paid it or when i shut it off?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; Thanxs&lt;/P&gt;</description>

      <description>&lt;P&gt;Robert, should I DV and then wait for them to sell to another CA? I realize the SOL is up on it- it's like $430 dollars disconnect fee for two phones, but the entry is one of two CA's unpaid on my report. GW's aren't working for my paid ones, so if I could negotiate a PFD on this one &lt;EM&gt;before&lt;/EM&gt; I pay, it should help a little if it works.Thanks for the SOL info.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If SOL is up, maybe I can call and have the upperhand? I just want it gone, and since it's already hurting me, if they don't agree to my offer I can move on and pay the other collection I have. Just wondering what to do...&lt;/P&gt;</description>

When you no longer made payments and never caught up, start then.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;ETA- My phone was disconnected May 2006; I had called in April to negotiate a payment plan on both phones as I was hospitalized, and we worked out a new due by date for the full amount. Before said due date came around, my phone was disconnected and they had sent the full amount plus disconnect fees to collections- before the agreed upon due date. I get that a lot, hospitals are notorious for that in my experience. lol. After awhile they threw out the monthly bill fee, and just sent the early disconnect fees for collections. They shut off in May, but the month I "skipped" my payment was April.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
