I was on my way to having my entire Credit Report cleaned and ready for a mortgage, however at the last minute I pull the report and find a new entry from Enhanced Recovery. I called in about a month ago and found out the debt was for Comcast back in 2005. I requested a delete for payment in full, they agreed, but that has been a month. I called back in to find out why it has not been removed, they said it was policy not to remove any debt.

So I do some research. Apparently, if I understand correctly, it was illegal for them to even collect on this debt since it was outside of the SOL and reporting on your credit report is considered an attempt to collect on a debt.

Anyway, that might all just be noise. Has anyone had any luck getting in touch with a CEO or Senior VP over there and having items removed?

Thanks

The SOL is set by each state and is the amount of time a creditor has to bring a succesful lawsuit against a consumer for unpaid debt.

The CRTP determines how long something can be reported. A collection can be reported for up to 7.5 years from the DoFD (Date of First Delinquency) on the OC (Original Creditor) account that led to the collection.

Also even after the CRTP and SOL have expired the debt remains and collection efforts can continue forever at least in theory.

From a BK years ago to:
EX - 3/11 pulled by lender- 835, EQ - 2/11-816, TU - 2/11-782

"Some people spend an entire lifetime wondering if they've made a difference.

@Anonymous wrote:

No I paid the CA this prior to being notified by the CA of collections or the account. Found it on the credit report and called in an paid.

Since it's paid your only option now is to write what are called GW (Good Will) letters to the CA asking them to remove this from your reports. They are under no legal obligation to do so and that's why you are asking for their "goodwill" to make this happen.

Some creditors are easier to work with than others and some never seem to grant GW's but it's always worth a try. You can do a search here onsite to see how others have approached this and what seems to work and not work. I say it's worth trying to get this removed because a paid collection hurts just as much as an unpaid one although if this is from 2005 it hurts much less than a newer negative.

Do you know the DoFD that led to the collection? As I said before this can't report longer than 7.5 years from that DoFD and if you know that date you'll know when this will be gone from your reports just from natural attrition.

If you haven't pulled your free credit reports from annualcreditreport.com you can do that and Experian and Transunion will have the drop off dates. The Equifax report will show the actual DoFD. I have found those dates to be pretty accurate.

One last thing. I have to assume that there are late payments showing on your reports that happened before the collection? These late payments are part of the OC account and will be there even if the CA agrees to delete the collection. You'll also have to contact the OC and try and get them to GW those lates and sometimes there is a charge off after the late payments. It never seems to end huh?

If you can't get the lates removed early they will drop off at 7 years from each individual date of delinquency and if there is a charge off the same 7-7.5 years as a collection applies.

From a BK years ago to:
EX - 3/11 pulled by lender- 835, EQ - 2/11-816, TU - 2/11-782

"Some people spend an entire lifetime wondering if they've made a difference.
