When a creditor or debt collector tells you that the FCRA prevents deletion, that is untrue.

FCRA 623(a)(1)(A) only requires that information reported to your credit file not be knowingly inaccurate. The converse is not a requirement that information must remain in your credit file if it is accurate.

Their restriction against deletion is only, at best, pegged to their credit reporting agreement with the CRAs.

The credit reporting manual used by each of the three major CRAs does include the specific administrative instruction that prior, accurate reporting is NOT to be deleted based on payment of the debt.

It is an administrative matter on their part, and not a statutory prohibition.

I've sent off a few PFDs and got my first responses; a yes from CBA and a form letter no from Credit Collection Services. The CCS is a Ca of an insurance account from 2007 for $170.

The form letter says:

"we are in receipt of your correspondence stating you will pay the above balance if we delete it from your credit bureaus.

Definitely try again! Yes the FCRA does state they have to report accurately, it doesn't say they can't delete a tradeline! Keep sending those PFD letters. Try to find a different address, maybe someone in management's name and address it to that person directly. Do not give up. Eventually someone will accept your terms!!!! Good luck!

AndySoCal: Great question. I wasn't even aware the debt existed. It appears only on my TransUnion report. How can I tell who owns it?

If CCS owns it does it make any sense to pursue with Progressive?

To find company contacts, I normally google, try different variations of what you are looking for, i.e., "ccs ceo", "credit collection service ceo" "ceo of credit collection service", "credit collection service pfd letter", etc.

Also, try other searching debt help boards. There are tons that I've found in my searching. Though I LOVE myFico, there are other credit help boards out there with people that have the same issues as you may have. The point I am trying to make is, you have to do alot of research, sometimes it may take hours to find that one link to a possible CEO, VP, department manager. Don't give up!

Call Progressive and see if thye sold it to the CA or it is assigned. And tell them what you said you were not aware of the debt until you saw the collection account. See if they can supply more information as well.
