      <title>Collection agency mystery</title>

      <description>&lt;P&gt;I have an old account with Plains Commerce Bank, that is about 6 years old. &amp;nbsp;It is slated to fall off my report in October of 2012. &amp;nbsp;I recently noticed on my CR that the balance went from $1220 to $0. &amp;nbsp;I am trying to find out who Plains Commerce sold or assinged this account to in order to avoid a CA reporting on my CR. &amp;nbsp;I disputed the tradeline with Equifax and noticed on my scorewatch report that it now lists Alegis Group and this address:&amp;nbsp;3817 S Elmwood Ave, Sioux Falls, SD, 571056565﻿. &amp;nbsp;When I google this address, I find that it belongs to Resurgent Capital to which I also see that Resurgent Capital is out of business. &amp;nbsp;How do I proceed with this? &amp;nbsp;I even tried calling the OC, and they couldn't give me any information on this account. &amp;nbsp;They were not able to find anything pertaining to my account via my SSN, First or Last name. &amp;nbsp;Should I just wait for a collection to show up on my credit or do I try to find out who this account belongs? &amp;nbsp;Any help from any of the moderators would be awesome!&lt;/P&gt;</description>

      <description>&lt;P&gt;If the OC has updated their credit reporting to now show $0 debt balance, then that is indication that they no longer own the debt.&lt;/P&gt;&lt;P&gt;They dont have to notify either you or the CRA of their internal business dealings, including&amp;nbsp;name of the new owner.&amp;nbsp; However, it is just plain old good business practice to provide you that information.&lt;/P&gt;&lt;P&gt;Until the debt collector either contacts you or reports to your CR, you are at a real disadvantage in pursuing the matter.&lt;/P&gt;&lt;P&gt;I would continue any efforts available to secure the name of the new owner.&amp;nbsp; The minute you know who they are, you can send them a DV letter.&amp;nbsp; You dont have to wait for any contact with you.&amp;nbsp; Most debt collectors wont remain dormant too long, as collecting the debt is their job.&lt;/P&gt;&lt;P&gt;If their first contact with you is a phone call, get them to say that they are calling with regard to a debt, and then just tell them to make all future communications with you in writing.&amp;nbsp; That does not compel them to do so, but is just&amp;nbsp;a convenient way for you to terminate the call.&amp;nbsp; By saying that they are calling regarding a debt, that establishes an intitial communication with you, thus triggering their requirement under FDCPA 809(a) to send you a formal collection (dunning) notice within 5 days therafter.&amp;nbsp; That gets the ball rolling.&lt;/P&gt;&lt;P&gt;All I can advise now is to continue efforts to locate them, and in the meantime, be ready when they call.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
