Okay. I just finished writing all of my Goodwill letters but I have another question, of course. Lol. Is it too late to PFD a collections account that you've already started paying on? I have one for 1400 and another for 2500. I have already paid them 2 payments of $75. Did I hurt myself by doing that?

This is all the debt I have on my credit report. If anyone can give advice on how to repair and rebuild my credit to have my low score of 500 go up to 600-650 in 1year, I would greatly appreciate it.

1. 1 Judgement that shows up on my credit report twice (duplicate). Scheduled to come off 12/2010. I sent a copy of the Certifiied Cancellation of the Judgment and sent it to the credit bureaus. If it boosts a lot in the first 3 months, I will be encouraged to keep at it. I don't want to get discouraged and quit before I'm done. I would really love to see my credit score 650 or above, and I would really like to accomplish this in a year.

My biggest problem is the company that I have the medical bills with has been picked up by TeleRecovery and Southern Credit Recovery. TeleRecovery has been paid but Southern Credit Recovery has not. I guess I will try PFD because the OC bought the hospital I work for so I now work for these people. I don't want to give them any reason to fire me after 7 years of working there.

TU

Sorry to hear about your situation, I wish I had specific advice for you, but all I can say is that you have to dig in for a marathon. If all of these accounts are accurate, your best bet is to see if you can get the collection agencies to delete the information (assuming you paid in full) but thats no guarantee. Defintely try to keep some of your accounts, so you can establish a history of on time payments and so that you have some old accounts in your credit history. Hopefully, some of the wiser hands can give better, less obvious advice

Honestly, I would DV the collection accounts that will be falling off in '09-'11. Simply because chances are, they either won't have the info any more and won't be able to validate OR that they might be too durn lazy to even try validating. If they don't/can't validate, by FCRA, they HAVE to delete (but that doesn't mean they always do, of course).

That course of action won't help your score go up drastically, since because they're so old that the CAs won't be able to validate, they're also so old that they're not having as huge an impact on your score as the newer ones are.

If ANY are medical collections, I'd not even bother DVing them until you've sent the OC (healthcare provider) a HIPPA letter (insert "b"). I don't know much about the HIPPA letter, per se, but from what I understand, it more or less threatens the healthcare provider with violating your medical privacy laws in continuing to allow a CA to report your medical debt (rather, violating the HIPPA by sharing your medical info with a CA).

For the lates, GW, GW, GW, GW. And if that still doesn't work ... GW some more. It's sort of the same principle as having a roomful of monkeys banging on typewriters -- some day, someone will get your GW and will respond favorably to it (and Lord knows, most CAs aren't even as bright as a monkey!).

For the SLs, I personally would work my patootie off and get the one in collections in some sort of payment plan. The Feds are notorious for making your life a living heck in order to get their $$ back. And meanwhile, you run the ugly risk of your $11K loan turning into $20K in fees and collection costs (CAs for SLs can tack on 40% in fees).

Further, that SL MAY come off in '13, but chances are, the DoE will claim it and then THEY will report it on your CRs. Then, they'll "sell" it to another lender and the whole mess will start over again on your CRs. The DoE can keep that ugly on your CRs forever and there's not a durn thing you can do about it aside from paying it off.

And you probably already know this, but there is NO SoL on SLs ... so they can ALWAYS take action against you. They can even take your house. Freeze your accounts. Take your tax refunds. You get the picture.

For the COs, if paid, GW, GW, GW, GW. Like the lates, if that doesn't work, GW some more. Sooner or later, someone will have a heart and will pull a virtual string or two and take them off your reports or will remove the CO status.

For the UNpaid COs and collections, PFD'em. Negotiate for a PFD by offering them 75% of the amount owed in exchange for taking the uglies off your CRs. If they refuse, up the ante to say, 80% and so on. But be prepared to pay in full for the deletion. They are under NO obligation to negotiate. They're not obligated to delete the TLs, either. But it's usually in their pockets' best interest to do so.

For your COs and CAs, give the names. Someone here (there's OODLES of people here, in the same boat you're in!!) will have dealt with them. Someone might even be able to give you a backdoor phone number or "responsive" person to ask to speak to/deal with. At the very least, they'll be able to tell you what DIDN'T work with that particular CA or OC.

The most important thing, though, is to share information ... that's the best way to get help. Start by posting the CAs for the UNpaid collections here. Someone will be more likely to read your post and answer with their own experiences.

I think your next most important step in repairing your credit is buying oodles of paper, ink, envelopes, and stamps!!

And ALWAYS remember: if you DV or HIPPA. send it Certified Mail, Return Receipt. That gives you proof so if you have to dispute directly with the CRAs, you have proof that Soulless Collection Agency, Inc failed to validate and they need to be deleted off your CRs.

I've given you basic info that pretty much anyone here can give ... until you post more specifics (including the state you incurred the debts in and your CURRENT state), that's about all that can be said, I think.

I hope you'll come back with more info ... and more questions!! Welcome to the Forums!!

Wow!!!!
JewelryGirl,

DV Southern Credit (they are all medical right?) They can't validate. Dispute the day after or the same day that you send the DV CMRR.

Then work it out with the OC. Within 30 days you'll have 6 less collections... They just deleted my 2 Southern Credits from EX today. Now all I have left is TU that I'm waiting on.

Why in the world would they fire you?????

First of all, unless the OC was your employer at the time the medical bills were incurred, they CANNOT have access to your medical files. Employers simply don't have the right to access those records.

If your concern is that they can search the system and somehow FIND your account if you DV them, and make the connection that you're an employee, I'm pretty sure that if they attempt any kind of retribution, they'd be violating the HIPPA. UNLESS, in your employment agreement/contract/application it somewhere said that if you owe them money and don't pay (or dispute the bills) they can fire you (and even then, I'd say that the average judge would toss that agreement out the window if you fought it). Otherwise, you'd have grounds for a lawsuit.

Unfortunately for THEM, you have the rights, as bestowed upon us all by our Federal government, to dispute charges that you feel are inaccurate ... you have the RIGHT to request debt validation (regardless of whether you feel there's any inaccuracies), regardless of ANY conflict of interest in re employer issues.

The ONLY worry you should have is judgment. You're obviously easy to find if they decide to serve you ...

My advice from before still stands. EXCEPT HIPPA (insert "b" ) all the debts you've paid ... send the HIPPA to the OC/healthcare provider.

Do a search for the HIPAA letter and you'll find the main website that details the HIPAA process.

You'll find "insert b" lower on the page. Modify the letter as needed to reflect your account number, healthcare provider, etc.

While you can send payment with the HIPPA (insert a) ... personally, I wouldn't. I would, if I were the OC and felt like being a poophead, simply tear up the check (or money order, cashier's check, etc) and let someone roast for 7 years. My point is, AFAIK, the healthcare provider, once they send a debt to a CA, is under NO obligation to accept payment from you. They can simply tell you "thanks, but no thanks. Talk to the CA."

Hubby calls it "begging forgiveness, rather than asking permission" but I call it covering your patootie.

The debts you haven't paid, PAY them and then HIPPA the crap out of them.

The SLs I still don't understand. To make it easier, I'll explain what you SHOULD be seeing. If you're not seeing what I describe, then Houston, you may have a problem!!:

Let's say you had 6 SLs. You defaulted on the 6. What happens after that is that they are subrogated by the guarantor (often the DoE or state equivalent). They are then (for lack of a better term) "sold" to another lender OR assigned to collection. You will then have TWELVE SLs on your CR. SIX showing derogs (lates), BUT marked either "PAID" or "TRANSFERRED." The other SIX will be (hopefully) marked "PAYS AS AGREED."

If you then consolidated them, that would be yet another loan. If that is the correct scenario and they do NOT state that the original loans are "Paid" or "transferred" AND show a $0 balance, you've got screwed up reporting right there.

If the "second" set of loans were consolidated into one, and they are not marked "PAID" or "TRANSFERRED" and they do NOT show a $0 balance, that, too, is incorrect.

It almost sounds as though you had 6 SLs, they defaulted, you got 6 more (?) and then consolidated the "NEW" 6. In that case, you should have 13 entries on your CRs. SIX for the original, 6 for the "claimed or collections" and ONE for the consolidation loan.

The reason why I think that you have actually 13 different loans is that I BELIEVE that USA Funds was the original lender, and then they were "sold" to or being collected by "SM." Is that correct? Can you provide a time line for the loans?

Holler back about the SLs ... personally, I think the collections are so old that while they're worth your time getting them OFF, I think the SLs are the highest priority. They can kill you in the long run. I wasn't kidding about ugly interest and collection fees.

Well, I have started a list. So far I have 11 GWs to write and 2 PFDs. Wish me luck. I am still oblivious as to what to do with the SL that is in collections. I guess I can try the PFD but that will take me a while since it is an 11,000 loan. I can pay that by the end of next year, but that is the soonest I could accomplish that task. Any other advice is welcome.
