In april of 2011 i paid a Jugdement. i had no knowledge that i was ever served. i came across the Judgement while looking to buy a house. to my suprised there it was on my credit report. after researching, i found the company, immediatly contacted them inquiring. basically due to the lack of knowledge agreed on payments. i was persuaded by threats made of things they could possibly do to me if i didnt willingly pay them. i paid. after reading many threads on this form i realize i was never properly served papers. not only didnt i recieve a notice, i didnt live at the address the sent the notice to. therefore i missed the court date and didnt get a chance to defend myself. im entertaining the idea of filing a motion to vacate judgement. do i have a valid case or am i just wasting my time. please help me im in need of some detailed help

The first thing u should do, IMO, is go to the courthouse and get copies of your file related to the judgment and see if they served you or how they served you -- this way you go in w/ knowledge. Proceed accordingly once you have all info. Good Luck.

06 will probably better explain, but serving you papers for a court case doesn't mean they have to physically hand it to you. There are many ways they can legally serve you notice, some of which seem ridiculous. It really depends on the state. What state do you live in?

In Oregon they can get away w/ certified return receipt. I signed that I got it - the judgment got signed by the judge.

I read another post saying a person has to try to vacate the judgment within a year - IDK if that's true or not. Something to think about.

We we moved into an apartment a few years ago I was served someone elses judgement papers! I told the guy I wasn't that person but he said he had to leave them there and I could just throw them away or whatever. I found it so strange.
