      <title>Trident ding on Credit - DV or PFD</title>

      <description>&lt;P&gt;I recently went to refinance my house and found a Derogatory Remark on my Reports. This dropped my score considerably to around 660. Because of this my refinance rates are .25 - .5% higher (adds up to a good amount of money over 15-30 years).&lt;BR /&gt;&lt;BR /&gt;The CA was Trident and it looks like its for $139.00 and OC was Columbia House. I cancelled and account with them years ago with nothing owed. I really don't have time to screw around with going back and forth with these jokesters so I am wondering what way I should go to get this removed from all my reports.&lt;BR /&gt;&lt;BR /&gt;I have seen a few postings saying to send a DV letter Certified Mail and then a PFD.&lt;BR /&gt;&lt;BR /&gt;Would anyone recommend just sending a PFD waiting for a response and paying the damn $139 or is it better to send the DV first.&lt;BR /&gt;&lt;BR /&gt;Can anyone please post a sample of each letter to sent as well.&lt;BR /&gt;&lt;BR /&gt;He is an example DV I found on another website but I am unsure if that is still valid as it wasposted in 2009 and I dont know if I need something that long.&lt;BR /&gt;&lt;BR /&gt;&amp;nbsp;I couldnt find a boiler plate example of PFD Letter. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.&lt;BR /&gt;This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. But that example is much too long and contains requests that a CA is not even required by law to provide. Keep the DV simple. Something like this:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;STRONG&gt;&lt;EM&gt;"I pulled my credit bureau report, and I discovered that you claim I owe you a debt. Under&amp;nbsp;FDCPA 809, send me validation of this debt."&lt;/EM&gt;&lt;/STRONG&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;STRONG&gt;&lt;EM&gt;"You claim I owe you a debt. In accordance with FDCPA, send me validation of this debt."&lt;/EM&gt;&lt;/STRONG&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;EM&gt;&lt;STRONG&gt;"I received your letter claiming I owe you a debt. If still within the SOL make sure you have the funds to pay in full before sending the PFD because the creditor &lt;U&gt;might&lt;/U&gt; answer with a lawsuit. Reports from third party sites (including myFICO) often don't have the most complete information. The SOL can be from 3-15 years depending on the state and type of debt. You can do a search for your state to confirm the SOL.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The SOL usually starts at the DoFD (Date of First Delinquency).&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Why would they sue you? If you send a PFD they know you have at least some money to pay this debt so they might sue to try and get all the money owed. That's why if the SOL hasn't expired you need to be sure you have the funds to pay in full before sending a PFD.
