Hello...

Back in 2003 I rented a room at a house that was near a college campus. Decent rooomates, setup was we each rented direct from landlord, utilities included. Times got tough, and the landlord started taking some sub par tennants... i.e. tweakers, thieves, at one point we had the police raiding the place looking for a tennant.

My company offered me a promotion and relocation, so I gave 30 days notice, payed rent, and left. It was before the end of the lease.

Landlord apparantly served someone (not me, I was in Phoenix) with papers and got a judgement against me for $2,000 for alleged wear and tear of common areas since I was a no show.

Now here I am with a Judgement. It is dated 9-2004. So, my questions:

How long will that Judgement stay on my credit report?

Does paying it make a difference?

How much does it affect my credit report?

It only shows on Equifax; Should I be worried that it will show up on the other two?

Do I have any legal recourse to appeal this much later?

I live in CA but the Judgement is WA, any info on SOL?

Any help appreciated, thanks. The rest of the story on my log:

http://ficoforums.myfico.com/fico/board/message?board.id=rebuildingcredit&thread.id=16121

6-4:

EXP - 577 EQU - 530 TRANS - 542

7-15:

EXP - 614 EQU - 603 TRANS - 644

Greetings,

I got served last year for a Best Buy Account in the amount of 3,298.13. I of course was a no show and the plantiff won the case and got the judgement reported to the CRAs TU and EQ as public records afterwards. I was able to reach the Lawyers Office and asked if the Public Record would be deleted if the balance was paid. She said she had no control over that but they would report it as PAID to the client which is LVNV Funding and it would be up to them to make that decision. You guys think I should use a PFD to ( LVNV Funding ). I really want this to come off my Credit Report but if it's not going to be removed after I pay it, I might as well live with it on my record as unpaid anyway until 2013. The date they reported it was 03/06. The Date of Last Payment was 10/01. Wouldn't the date of last payment make it fall off after 7 years? Would the Public Record also fall of to?

Thanks

Message Edited by theshadow12345 on 07-10-2007 07:08 PM

LVNV are not nice people to deal with. I believe it is 7yrs from the date it was filed since it is a judgement now. A judgement can be renewed every 7 to 10 yrs with the courts. Plus in some states they can garnish you r wages. They also are allowed to add intrest to your judgement which means even more money. If I were you I would do some research on LVNV. You should google that and do some reading I found some interesting things there that may apply to your situation and may help you to get the judgment vacated. Keep us posted and I will see what I can find for you as well just be careful dealing with them and there so called attorneys.

Debbie

A judgment is a little different than just letting it sit on your credit report. One Judgments are renewable and as you can tell they are killing you CR. But more importatly, now they have won the judgment they can legally seize your bank accounts, garnish your wages, seize your tax returns, put a lien on your house, if you have one, may even go after your car.

You no longer are sitting with any kind of leverage so I would try a PFD, I mean it can't hurt, but I wouldn't play hardball with them. They got the judgment.

Shadow - from what I'm experiencing with them they are the "quiet behind the scenes" baddie and hire out CAs to do the actual suing. Judgments are reporting for 7 years; does not matter if they are paid or not (according the CRs); and LVNV can't change that portion of reporting if the Court document was filed.

There are over 40 lawsuits against LVNV in TX for various violations of consumer rights - good luck - I think I'm about to get hammered by them myself even though they've never proven they have the authority to collect on the account. I made the mistake of going to court without a lawyer and I'm hoping this lawyer I found will take the case & help me fight back.

They are slick in your case because your SOL for MN is 6yrs across the board and that is not up until 9/2008 in your case so they filed just in time but I would make sure to bring your proof that they did not validate to court with you and anything else you can get your hands on like disputes you have made with CRA as well.

Ok I went ahead and did a PFD letter to the CA. I have a question though, Since the Attorneys Office wants the payment for the Balance of $3239.43, should I send payment to them or LVNV funding?

Thanks

I called attorney already and she said that they would be the one to receive the payment to give to thier client. That way they can dismiss the case and all that other Court Stuff they have against me.

Just an update:

I called LVNV funding and they were able to see my account as being reported to an Attorneys. When I told the Rep that there was a judgement against me she said that it wasn't on thier computer system and was suprised about it. I asked if I paid the Balance if they would remove the Account and all Public Records and she said they would but they would need the Judgememnt Date, Case #, The Amount Owed, The District, and Interest Docket (or something like that? ) from the Attorney. Im waiting call from the Law Office for this information so I can complete this PFD letter and send it to LVNV Funding.

I also tried Bud HIbbs and explained my situation to them. Waiting to hear from them also..

Hopefully something works out here. This judgement is hurting my score and alot of more other things.

Thanks for the Help

TS

OK im so close in paying over $3000.00+ for an LVNV funding account (Best Buy) that was reported to an attorney. I called the lawyers Office and he said that the Public Record Will not be removed even after I pay it. It would though put it as a PAID status under my report. BudHiBBS said that the only thing to do is pay and they can mark it as satisfied which would enhance my score.

Im just wondering if this will help me to purchase a new home down the road with my Bad Credit. My TU Report looks like this with a score of 504...

Total past due $15,448
Credit History 19 Years

Late Payments 22

Total balance of Your revolving accounts $6,530

Your mortgages None

Your installment loans $33,795

Total number of Accounts 38

Accounts with balances 16

Accounts opened in past year 4

Recent inquiries 11

Collections 7

Public Records 1

Thanks

Message Edited by theshadow12345 on 07-10-2007 08:36 AM

Bud Hibbs is a little swamped I think the best time to contact him may be around 5:00 his time. I spoke with him last night and he put me on the right track as to what my next move will be. That is what I am working on now. Just make sure that if you get them to agree to the PFD that you are careful of how they word that and I would still speak with Bud if at all possible or send him an email. I send one yesterday morning and he got back to me just before lunch yesterday to have me call him. Good luck

Debbie )
