Yes, I have a letter. Besides that issue, the medical facility that sent it to collections knows the history on the acct and agrees it should be removed completely. Long story, it should never have been reported in the first place. It is so frustrating because this has been going on now for about a month. I want to wrap this up very quickly so as to apply for a refi. The bank said I should have at least a 660 fico and because of the collection I have a 634. I don't know what my score will jump to but it's bound to be close. The bank suggested waiting for the bump (that doesn't see like it will ever happen).

Thanks for taking the time to respond.

I just received a credit alert and pulled a copy of my transunion credit report. I did a pay for delete with a particular collection agency. I have waited weeks for them to move on this. I even contacted the original medical facility numerous times to get them involved in getting the collection agency to remove it. The girl at the doctor's office said they work for them and it should be no problem getting them to move on this. Well, low and behold it shows as a chargeoff with a zero balance. I have a letter stating they are to expunge the account.

I am calling the medical facility again on Monday to have them contact the collection agency once again. What is a reasonable amount of time to wait to have this account deleted? We want to refinance our home and this has been holding us up for weeks now. Can an immediate deletion take place? Can the medical facility call Transunion directly to get this done or do they still have to deal with this collection agency?

Thanks.

Hmm, if it were me I would make a copy of the agreed upon letter and forward it to the collection agency, medical facility and the credit bureau(s) that it is listed on along with a letter from you stating that you held up on your end of the deal and if they do not live up to their end within 15 days (or whatever time period you seem fit) you will be contacting a lawyer. Good Luck!

Hello, and welcome to the forums !

How long ago did they supposedly request the deletion of this account ? It definately sounds to me like the CA did an update to the account rather than the delete that they agreed to. Assuming that you have a copy of the agreement in writing, I would follow up with the CA again, as well as the medical facility.

Companies always say to give 30 to 60 days time for updates or deletes to occur, but in reality they can happen much faster, like within a day or two from when the update is sent, assuming that it is accurate and is processed correctly.

Thanks. The medical facility knows it should be deleted. It's the CA that is holding everything up. They are real unprofessional and quite rude.

Anyway, I know it will be done eventually but we need to refinance asap. I was just wondering how fast this could be done as we want to meet with the bank next week and my scores could use the boost.

I called the medical facility on Wednesday and the girl said she would have them call it into Transunion. They did and it reported paid/charge off on Thursday. Grrrr.....

Kate

Yeah I know its frustrating. And on their best days most CAs are unprofessional and rude.

The delete will very likely have to come from the CA since they are the entity that reported in to Transunion. Did you say that you had a written PFD agreement with them ?

If I understand your scenario correctly, the OC shows a charge-off with $0 debt balance?

If that is the case, then the OC sold the debt to the debt collector. Thus, the OCs statement that the debt collector "works for them" has me confused.

Additionally, the OC cannot compel a debt collector to delete their own reporting. They can only ask....

The charge-off, if reported by the OC, would be unrelated to the collection, and the debt collector cannot agree to its deletion.

Can you explain the situation a bit more?

If you have acknowledgement from the OC that the debt itself was improper, then there would, of course, be no valid debt to support a collection.

I would suggest putting together your documentation from the OC, and using it as a basis for a direct dispute under FCRA 623(a)(8), addressed to the debt collector, challenging the entire accuraqcy of any debt upon which to base their collection.

I would NOT dispute through the CRA and take the likely chance that they will sanitize your dispute through their e-OSCAR process. You want to ensure that all of your documentation is provided to the debt collector, and that they respond directly to you.

Hello OP,

It has been my experience that Transunion updates about 2 weeks after the other CRA's. Also if you dispute the collection and the update comes through, they will not update so if you have the letter you can fax over a copy to dispute or ask ca to resubmit and give it time.
