    <description>&lt;DIV&gt;&lt;/DIV&gt;&lt;DIV&gt;I've fired off a complaint to the BBB of San Diego with regards to Midland Credit. They are reporting on my TU &amp;amp; EQ CR's.&amp;nbsp; I have DV'd Midland 2 times to no avail.&amp;nbsp; Disputed with TU/EQ and both continue to verify/update.&amp;nbsp; The BBB just sent me an email with disclosure authorization form to complete, as well as the following statement from Midland:&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&lt;P&gt;&lt;FONT size="2" face="Verdana"&gt;&lt;SPAN&gt;***&lt;/SPAN&gt;&lt;/FONT&gt;&lt;STRONG&gt;&lt;B&gt;&lt;FONT color="black" size="2" face="Verdana"&gt;&lt;SPAN&gt;Midland Credit Management&lt;/SPAN&gt;&lt;/FONT&gt;&lt;/B&gt;&lt;/STRONG&gt;&lt;FONT color="black" size="2" face="Verdana"&gt;&lt;SPAN&gt; has indicated they cannot&amp;nbsp;disclose confidential information without your consent. Enclosed/Attached is a disclosure form which needs to be signed&amp;nbsp;and mailed, faxed or emailed back to our offices within 14 days of receipt of this notice. Without this form we&amp;nbsp;will be unable to assist you further.       <description>&lt;DIV&gt;have you been sending the DVs CMRRR? If so, and you have the Green Cards, then send the ITS letter CMRRR, and maybe two or three weeks later actually file a small claims suit in your local jurisdiction for violation of the appropriate federal (and possibly state) act.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;When filing out the small claims form,&amp;nbsp; you'll need to find out how the violations are in terms of damage ($1,000 per instance?) and take the stance that Midland violated you 3 times (for each CBR).&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I'm doing the same thing, but I'm at the stage where I'm about to file the small claims suit, just waiting out the 30 days of the ITS letter.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;In addition, since I live in California and&amp;nbsp;Midland never notified me that they were reporting this negative information, Midland&amp;nbsp;is in&amp;nbsp;violation of California Civil Code 1786.25 (2)(b), perhaps another $1,000 fine?&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;All told, I could be looking at $4,000 in awarded damages, compared to the $78 they claim I owe.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;If you live outside of California, it's unlikely that Midland will send a representative to your court of jurisdiction to defend, and YOU'LL win by default judgment.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;I certainly do have all copies of the green CMRRR's showing their receipt and signature for receiving my DV requests.&amp;nbsp; I was hoping to have some success with the BBB, but now I see that is not going to happen.&amp;nbsp; I've already worked up an ITS letter, and now I am going to send it on it's merry way.&amp;nbsp; Due to Midland's reporting this invalidated account, they have now cost me by being denied credit.&amp;nbsp; I have a few violations already against them (sending me a "settlement" offer after my 2nd DV attempt), updating/verifying with the CRA's and not validating this debt.&amp;nbsp;&lt;/DIV&gt;</description>
