    <description>&lt;P&gt;Hi guys, im kinda new to the forum and basiclly repair my credit. Im currently stant at 657. Having 2 charge off and 1 collection account. The reason i bring up to the forum today because i had midland funding account list as a collection account. I have not know about this account so i file a disputed and everything.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Negative items: 1.Capital one charge off ( Midland fuding llc bought it (actually report as collection account ) The account is SOL and i have not know about this specific account.&lt;/P&gt;&lt;P&gt;2. Chase charge off account $ 1600 with 0 balance report.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So the first thing i did with Collection account Midland is :&lt;/P&gt;&lt;P&gt;June: receive a collection and settment from midland to paid for less&lt;/P&gt;&lt;P&gt;June 26 : Sent them a validation letter.&lt;/P&gt;&lt;P&gt;Wait a month hear nothing from them&lt;/P&gt;&lt;P&gt;July 26: sent them another letter to get a debt validation again and ask them to remove and delete an inaccurate information it if they cant provide those information.&lt;/P&gt;&lt;P&gt;August 9 : Receive a letter from Midland. Here how the letter goes :&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Dear Mr. XXX XXX&lt;BR /&gt;The purpose of this letter is to request your assistance so that we may reach a quick resolution to your dispute.&lt;BR /&gt;As part of our investigation of your dispute, it would be helpful to have a copy of any documentation you may have that supports your dispute. In the interim, we have requested that the&lt;BR /&gt;three major consumer credit reporting agencies change the status of this account to " Disputed"&lt;BR /&gt;Examples of such documentation include the following:&lt;BR /&gt;&lt;BR /&gt;1. Paid in Full of Account Settled: Proof of payment, for example: a) copy of front and back of payment intrument with copy of settlement offer or statement showing balance, B) copy of paid in full or settles&lt;BR /&gt;&lt;BR /&gt;in full letter, or c) other document showing balance has been fully satisfied.&lt;BR /&gt;&lt;BR /&gt;2. Fraud: a) copy of police report, B) Federal Trade Commission fraud affidavit ( which can be obtained at &lt;A href="http://www.ftc.gov/idtheft" target="_blank"&gt;www.ftc.gov/idtheft&lt;/A&gt; or c) notarized fraud affidavit.&lt;BR /&gt;&lt;BR /&gt;3. Balance Discrepancy: a) copy of contract that states rates for timeframe of disputed service, B) copy of bill that shows amount owed or rates, or&lt;BR /&gt;&lt;BR /&gt;c) more detailed explanation of disputed charges.&lt;BR /&gt;&amp;nbsp;We can be reached at XXXXXXXXX should you have any further questions. In the meantime, as requested by you we will no longer be contacting you regarding this account by phone or mail unless it is to further respond to a dispute by you under the Fair Credit Reporting ACt.&lt;BR /&gt;Sincerely&lt;BR /&gt;&lt;BR /&gt;This letter state out. Hmmmmm should i start to file a complain with BBB and FTC ? Or contact the Midland before i do it. I dont know what to do with them. I did call the orginal creditor which is capital one and they cant even valid the debt but told me to contact Capital One. I need to take both of it off my account. So if someone with experience deal with Midland Please try to help other. Thanks.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;ROFL,&amp;nbsp; Hello NIcholas.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&amp;nbsp;&amp;nbsp; I got the same thing when i Dv d MCM, they HATE resending to dvs. I hope you sent them return receipt, or they ll just deny them. &amp;nbsp;&amp;nbsp; WHat these requests for further information means is that they can't prove ownership of the account in question.&amp;nbsp; They are bottom feeders,&amp;nbsp; they have very little paper to justify their actions.&amp;nbsp; What they are asking you to do is to provide information to cut your own throat legally.&amp;nbsp;&amp;nbsp; If you search the message boards you ll find people in&amp;nbsp; similar situations.&amp;nbsp; You of course are under NO obligation to respond at all.&amp;nbsp;&amp;nbsp; I imagine if you called the original creditor you would find they have no original documentation either.&amp;nbsp; I m also betting that despite your repeated debt validation of MCM they are continuing to post negatively on your credit report via key derogatories?&amp;nbsp;&amp;nbsp; The bbb is a good start, ftc is good,&amp;nbsp; your state attorney general is even better.&amp;nbsp;&amp;nbsp; Especially if you happen to live in one of the several states that are actively suing MCM.&amp;nbsp; Google robosigning and you ll see why.&amp;nbsp;&amp;nbsp; Myself im pursuing the litigation route,&amp;nbsp; i cannot wait for my day in court.&amp;nbsp; The important thing about MCM is to remember that they are a bully, pure and simple.&amp;nbsp; THey ll lie , cheat, steal, whatever it takes to get your money.&amp;nbsp; Don't let yourself become a victims, or get pushed around.&amp;nbsp;&amp;nbsp; If you re lucky, ask Robert the best route to pursue.&amp;nbsp; He is a Fico Forum god, when it comes to these things.       <description>&lt;P&gt;They not going to take a penny from me but the only thing i want to do is i want to take them all off my credit report. I see my credit report so clean now after all the work out with inquiry, error report etc.....I just start working on my credit report and i see like 100 points increase but i might need more for my morgate rate by the end of the years. I been looking around around and around for the best question and answer for my case and couldnt figure what is the best way for this case. But i guess you were right about file a complain to bbb......Im going to sum up my file and everything to get a complain to Midland Funding. All they do is screw up other ppl life. And i need to get it clear with them. Thanks a lot for your advice ? And who is exactly Rober would you mind sent me his info. And what did you do for your midland case ? Would you mind to share.       <description>&lt;P&gt;Good for you!&amp;nbsp;&amp;nbsp; MCM wouldn't be able to steam roll people if more people stood up for themselves.&amp;nbsp; Unfortunately most people get sued by mcm,&amp;nbsp; and freak out then don't show up at court.&amp;nbsp; Or the people who have legitimate claims against them get talked into settling and still paying.&amp;nbsp;&amp;nbsp; They buy these debts on average at 3.3 cents on the dollar, so even a 50% settlement offer makes them tons of cash on the cheap.&amp;nbsp;&amp;nbsp; Robert is a constant adviser on this board, he knows his stuff forewords, backwards and inside out. He gives great advice.&amp;nbsp; You can find me by searching the boards.&amp;nbsp;&amp;nbsp;&amp;nbsp;&amp;nbsp; My journey with mcm began last year,&amp;nbsp; they committed several fcra/fdcpa violations that i could prove,&amp;nbsp; from their own letters no less.&amp;nbsp;&amp;nbsp; Thank god i kept the receipts,&amp;nbsp; recording their conversations scares the snot out of them too.&amp;nbsp;&amp;nbsp; You get the funniest reactions when you tell them your recording.&amp;nbsp;&amp;nbsp; But back to mcm,&amp;nbsp; so i filed a claim in small claims court.&amp;nbsp; They offered to delete in exchange for dropping my suit.&amp;nbsp; I refused.&amp;nbsp; Then removed it from small claims court, to federal court.&amp;nbsp; Which ironically is the best place for this sort of lawsuits.&amp;nbsp;&amp;nbsp; I hired a lawyer, they sent their corporate attorney,&amp;nbsp; and I just got their response to my first amended petition.       <description>&lt;P&gt;Filing&amp;nbsp; a small claims court is easy.&amp;nbsp; Just walk into your county courthouse, they can walk you through the paper work.&amp;nbsp; If your suing for over 2500 it s 90, under 50.&amp;nbsp; In my county at least.&amp;nbsp; Odds are they ll back off an offer to delete. In exchange for going away.       <description>&lt;P&gt;You dont need any paperwork.&amp;nbsp;&amp;nbsp; All you need is what your suing for, where to send it and then have them served. Or mail it yourself, and submit an affidavit of mailing.&amp;nbsp; Just a paper saying that you mailed it on time.&amp;nbsp; If they dont respond within 30 days you can get a default judgment. &lt;img id="smileyhappy" class="emoticon emoticon-smileyhappy" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-happy.gif" alt="Smiley Happy" title="Smiley Happy" /&gt;&lt;/P&gt;</description>

BUt if their behavior doesnt pass the smell test, ask a lawyer.&amp;nbsp;&amp;nbsp; THey ll take it on and you can relaxe and watch things from your couch.&amp;nbsp; Especially if you are the plaintiff, it gives you the upper hand.&lt;/P&gt;</description>

      <description>&lt;P&gt;Despite everything you read on the internet on how to dispute Midland, you can't win unless you have an attorney. &amp;nbsp;You cannot beat their attorneys on your own in court.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Despite the Attorney General's lawsuit against Midland for infractions including robo-signing documents, phoney affidavits and lying testimony, they are still doing all of this and succeeding.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Despite what you tell the judge, they will win the suit and be awarded a summary judgment against you.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;They do not have to produce "original" documents, verify the debt to you, answer your request for proof or Discovery, or "prove" anything. &amp;nbsp;The law allows them to collect on these debts and tack on attorney fees and court costs that can triple the amount of the alleged debt.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Midland is ruthless and will do what ever it takes to get &amp;nbsp;their money they feel they deserve . . . . . ethical, legal, or not. &amp;nbsp;They have attorneys everywhere. &amp;nbsp;And the problem lies with the judges that allow them to do this without valid proof.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;After my court hearing and, of course, losing to them, because I attempted to fight them on my own, my advice to anyone is get an attorney and, if you cannot afford one, &amp;nbsp;PROTECT YOURSELF. &amp;nbsp;Close any bank accounts, know your state exemptions if a sheriff comes knocking on your door, and anything else they may come after. &amp;nbsp;Be careful doing a Quit Claim deed or likewise, as this is fraud if done to avoid collection efforts.&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;Good luck!&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&amp;nbsp;&lt;/SPAN&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

They sent me letter for settlment but i deny it and ask them for debt validation but they fail for the first 30 days sent another debt validation sent me a letter that with more info that i dont have anything or have not know about this. I currenly complain with FTC, BBB......&lt;/P&gt;&lt;P&gt;I want to know there's any possible change to get the charge off ? and Collection remove ?&lt;/P&gt;</description>

I currenly complain with FTC, BBB......&lt;/P&gt;&lt;P&gt;I want to know there's any possible change to get the charge off ? and Collection remove ?&lt;/P&gt;&lt;HR /&gt;&lt;/BLOCKQUOTE&gt;&lt;P&gt;Gotcha.&amp;nbsp; So Midland basically is trying to reage the debt?&amp;nbsp; Should be able to get it off without suing.&amp;nbsp; Okay so they have failed to validate.&amp;nbsp; Did you send up followup letter saying they failed to validate and need to remove?&amp;nbsp; Also, how are they reporting it on your credit file?&amp;nbsp; Also, when was the DOFD (date of first delinquincy) with capital one?&amp;nbsp; You want to keep building up your paper trail until it looks overwhelming.&amp;nbsp; I had to do something similar with LVNV for my wife who had a genuine case of identity fraud.&amp;nbsp; Original creditor agreed it was ID theft but LVNV kept insisting they owned the debt now and would make the determination.&amp;nbsp; But they kept not responding to the ID theft removal requests.&amp;nbsp; Finally, I built up a ton of paper trail and delivered an Intent to Sue letter with all the supporting evidence.&amp;nbsp; It came off in 48 hours.&lt;/P&gt;</description>
