BOA is the only one reporting. However, they have not sent it to a CA yet. They are threatening my wife that they will if she doesn't pay. Even though she gives them her attorney information. What is the OC investigation letter?

What really irritates me is that anyone can apply for credit online and sign nothing and this makes you liable. This makes it really easy for theft.

I would sue them, but I need to see the actual application for my proof. I know I didn't sign anything.

My wife took this loan out to finish paying for her school. She also at the time had no clue as to what my ssn was. I am not even sure how BOA got it, but my lawyer says they could have got it easly and placed my name on the account.

Thanks.

Hello all

I recently saw my credit report and there is a Bank of America account that is charged off for $13,000. It is seriously hurting my credit. I have actually disputed this account with all credit burreau's and no luck. Bank of America comes back and says the debt is verified. I called them and tried to get a validation of the debt, something showing my signature, but they just send me the disclosure statements. I filed a complaint with the BBB and immediately got a call from Bank of America. They told me this account is mine. I asked for signature proof. They said they do not have that since it was applied for online. According to BOA, my girlfriend at the time, now my wife, applied for this account online. The money was transferred into our joint account so BOA put my name on the loan.

According to my wife when she applied for this account it was in her name only. We were not married at the time so we had no joint debt. When she gave them the checking account information, she only gave them my name because they needed to know who was on the account they were putting the money into. The statements always came in her name so, we never thought it was in my name until I tried to apply for a mortgage and this account was on there.

My wife is filing bankruptcy on this account and her attorney told us that they can put debt in anyone's name, but if they don't have my signature, they can't hold me liable for it. The attorney said they would deal with BOA if they try to sue me for it.

I just want this off my credit. It is seriously hurting it. Thanks for your help.

Is only BoA reporting or a CA as well?

If you have disputed with the CRA and BoA verified, send them the OC investigation letter. They are required to respond.

You may have to actually threaten to sue, just make sure you are prepared to do so, if they won't remove.
