calvary portfolio services - help please

i had a car that was repo'd in 3-05 by first investors - the balance remaining on the car at that time was $6100. when they tried to collect and pursue the balance i had an attorney send a letter stating they had violated the law on the repo procedures... i guess they are suppose to send you a certified letter offering you to buy back your car for one large final payment which i never received - they just went straight to the collection procedures. well, after the attorney sent the letter i never heard from first investors again. it reads on my credit report as: last payment 3-05, DOFD 3-04, date closed 6-08, activity discription trans/sold/paid. current status: charge off.

well, i just rec a call from CPS stating they had decided to sue me because i owe them $9360, i had no idea what they were talking about as i havent rec anything in the mail. it turns out first investors sold my acct to CPS and now what?? do i have to pay this CPS $9360? i told them i would not discuss it over the phone but to send papers and i would give it to the same attorney that handle this in 2005. they wanted his name etc immediately - which i dont know i will have to look it up...

please advise on how i should proceed. they said they wouldnt send any papers as they have already tried that - which i havent seen at all.

oh and the CPS is now a HUGE collection on my credit report which made my score take a large dive and i really wanted to buy a house in the next 6 months.

Send DV to the address on your CR. Do NOT talk to them on the phone.

I wouldn't DV CPS yet. We need to know which state you live in for the purposes of your SOL (statute of limitations). Do you have the money to pay this?

FDCPA requires that they send written communications within a set time after initial communications.

I agree with Fused-- more information is needed before DV'ing.
