      <title>Credit Report Help</title>

      <description>I have talked to all 3 CRB and they have all told me the same thing.&lt;BR /&gt;&lt;BR /&gt;I wrote a letter to Midland on March 19th, they received and signed for it on March 21st.&lt;BR /&gt;&lt;BR /&gt;They have not verified that the account they have on my CR is mine to this date. Yet, no any of the 3 CRB will take the item off. They said that they get verification that it is mine and it is up to me to prove it.&lt;BR /&gt;&lt;BR /&gt;What do I do now?&lt;BR /&gt;&lt;BR /&gt;Midland had 5 reports on my CR's and I have had them all taken off except for this one. And I am having major problems with this one.&lt;BR /&gt;&lt;BR /&gt;Thanks</description>

      <description>&lt;DIV&gt;If you do not believe this is your account and they have continued reporting after receiving DV, but haven't validated, then I"d file a complaint with the BBB. &lt;/DIV&gt;
&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;
&lt;DIV&gt;It took the full 30 days for them to respond, but filing a compliant with the BBB worked well for myself. &lt;/DIV&gt;
&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;
&lt;DIV&gt;Just state in your complaint what they are in violation of and that it isn't your account. &lt;/DIV&gt;</description>

&lt;DIV&gt;While it is true that the BBB can not legally do anything, many(including myself) have had great results with the BBB. &lt;/DIV&gt;
&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;
&lt;DIV&gt;The CRA only have to verify that the information they are reporting is the same information the creditor is supplying. &lt;/DIV&gt;
&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;
&lt;DIV&gt;It is not up to the CRA to enforce FCRA/FDCPA upon the CA. &lt;/DIV&gt;
&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;
&lt;DIV&gt;Unless the consumer provides the CRA with solid documents proving this is not their debt, such as a ID theft affidavit, as long as the creditor verifies the information they have provided, the account will remain. &lt;/DIV&gt;

      <description>Midland verified with BBB. They sent BBB a 2 page list of credit file. Out of the whole 2 pages there are 3 charges, 2 payments and the rest their monthly charges, overdraft charges, etc. They say it is for an Aspire Visa and they purchased it from Jefferson Capitol&lt;BR /&gt;&lt;BR /&gt;My question they sent nothing that I signed for. They said that they did not answer my DV letters because I did not respond with in 30 days of there request which was in 2006 I never received anything from Midland.&lt;BR /&gt;&lt;BR /&gt;Midland has this as an open credit on my CR&lt;BR /&gt;&lt;BR /&gt;MIDLAND&lt;BR /&gt;- - - - -&lt;BR /&gt;- Account No.: ************&lt;BR /&gt;- Condition: Open&lt;BR /&gt;- Balance: $1476&lt;BR /&gt;- Type:&lt;BR /&gt;- Pay Status: Late 120 Days&lt;BR /&gt;&lt;BR /&gt;&lt;BR /&gt;Where do I go from here. On my hard copy of CR it states the Date of status is 10/2004. If this was an Aspire Visa and they purchased from another collection agency how can it be an open account. Then they mentioned to BBB that they amount is higher then the original amount because they can add interest.</description>

      <description>sidewinder&lt;BR /&gt;&lt;BR /&gt;I am in VA and it is listed in my accounts section.&lt;BR /&gt;&lt;BR /&gt;I disputed with TU and EX and TU sent me an updated report with that item as deleted along with others. I posted about that in another thread.</description>
