yes and they stated that they sent info to midland 1 1/2 weeks ago that the account was paid and to remove, but according to Midland since tmobile no longer owns the account they cant request it be removed. I'm hoping Midland sides with me since I'm the consumer thinking that what t-mobile told me was true. Only time will tell.

SO I had a collection from t-mobile that hit my credit report in January for $742, t-mobile advised I could pay them directly which I did. I contacted Midland who advised t-mobile should have not taken payment since they no longer owned the account. I disuted with the CRA's on the basis of me paying OC directly. I have until 4/12/13 for the dispute to be complete, I'm praying Midland does not repsond. I also sent proof to Midland that I paid OC, they just sent a letter stating that they received my dispute and they have 60 days to do their own investigation. Does this trump the CRA dispute??????

By law they can not accept payment.

Wow I did not know that. Where does that put me at this point? I was advised that I can't put in a mortgage app with an open dispute on my Credit Report so I'm praying that within the next 2 weeks Midland does not respond and it gets removed

I spoke with someone from T-Mobile about an unpaid bill from 2007 that Midland has and was told that either could accept payment. I was also told that if I paid T-Mobile in full, they would send a request to have Midland deleted from my CR, and it would only take 3 days. I haven't paid it yet. Did you contact T-Mobile again?

The OC could only have accepted payment if they still owned the debt. If they did, they were required to update their reporting to $0 debt, and to have notified the debt collector of the fact that the debt was satisfied, which terminates the authority of the debt collector to continue any collection on the debt. So it is, at this point, and issue they must resolve between themselves.

I would get involved if the debt collector continues any collection activities after being notified that the debt is satisfied and does not promtply update their collection to report a $0 balance remaining under collection. That would be basis for a dispute over their reported balance.

As for the totally separate issue of a dispute of their credit reporting, satisfaction of a debt is not basis for requiring deletion of the collection. They reported the fact of having had collection authority, which is not negated by the unltimate satisfaction of the debt.

The CRA may choose to simply dismiss the dispute as frivolous or irrelevant without forwarding to the debt collector, as it has no basis. It is also contrary on its face to the clear CRA policy that information should not be deleted based on payment of the debt.

If they do forward to the debt collector, the debt collector need only respond that their reporting was accurate, and the CRA will conclude their reinvestigation by verifying the accuracy.

Even if they update it to $0 balance I would be satisfied. I just dont want any unpaid items since I'm trying to get a mortgage, I want to show that any debts are paid and satisfied.
