PFD sent to attorney...need help please

Ok, I sent the settlment PFD to the attorney twice now via email. Finally after the second time, i rec'd an email back. It said ...

If you would like to discuss this matter you will need to call Mrs. **** within 10 days. This communication is from a debt collector. This is an attept to collect a debt and any information obtained will be used for that purpose.

along with the email it had my letter attached to it......my question is, should I call or should I just reply back to the email so that I have everything in writing? also does anyone know why they put that info in the email saying this is an attempt to collect when clearly my letter was showing my attempt to settle? and I am settling with the full amount so its not like I'm trying to bargain with them.

OK, I called them and they wouldn't discuss anything with me until I verified my social and address. From reading in the forum I'm not to verify that stuff right??? If not then what do I do?

I would. They are an attorney/CA and can proceed with a judgment.

That is with a CA. This is an attorney who can file a law suit against you. If you want to make arrangements to settle you are going to have to give them some information.

Oh Ok, I gotcha now. That's why I asked I'm new at all of this and am trying to catch on to it all. Yes I'm trying to make a PFD type of offer with them so taht I can get the judgement vacated. I'll call them back. thank you

Ok , I called them back, the attorney is not friendly (that's putting it mildly) she said she will NOT file any motion to vacate after this is paid because that is an admittance of wrong doing that they would be telling the court and they aren't in the wrong. The only thing she will do is update it as satisfied when its paid. She said never ever ever ever will she vacate.

Help! What else can I do to get it removed?

Take what I'm about to say with a grain of salt:

I tend to be, ahem, fiery. I tend to be feisty and not stop fighting for what I need until my head bleeds from banging on walls.

Okay that said, I would look under NACA and find an attorney in your state that works with judgment defense, etc. I know in MN of two that specialize in this kind of work and have almost a 100% success rate.

You need to have an attorney talk to an attorney - otherwise, their legal education is > anything else. they are trained and paid to collect debts and do not care about your story, your situation, or anything else. The only way to level set the playing field, is to hire your own.

And IF you go that route, get everything promised to you in writing and stay away from the firms already noted on this and other forums as being ...credit repair. This is not about credit repair, this is about judgment defense.

And ultimately, you have to decide if it is worth the extra expense. In my case it was because I'm an executive who could be fired for having a judgment (old or new) on my CR.

If they won't vacate it there isn't much you can do. Even if you filed the motion yourself it would still need their ok on it.

Thanks for the info, I didn't want to have to have more expenses to fight this. The account is mine and my responsbility and I don't feel its worth that much extra time and expense.

And you can always pay and then request vacate in 6 months, then in a year... eventually, maybe they'll get sick of you bugging them and ask the court to vacate

Yes. It is a public record. It won't help your score to pay it but it WILL help when a real person reviews your file. It shows you owned your debt and paid it.

Paying a judgment should not impact your score one way or the other. But, I have seen posters get increases when theirs were paid. YMMV.

Hopelives2---that is true, mabye if I bug them enough after the fact it will help. I know it will help my score more if it were removed, but wasn't sure if it would atleast help a little bit since it showed paid instead of open.

Guiness56--good info to know, which makes it extra cruddy she wouldn't just work with me on it. I wasn't offering any less than what I owed, just wanted the judgement vacated....I don't think that was too much but guess it was.

at one point earlier in my life, some renters caused me so much anguish and stress, I took them to court for past due rent, etc. I tacked on all the fees, sheriff's serving costs, administrative costs, etc.

then I got a garnishment of their wages and took that too.

when it was done and overwith, about a year later, they asked for a vacate... I gave it to them. They had to ask twice. Once I denied it because I was "fiery" and the 2nd time, I just did not care and did not want to be "that" person that hurt someone else.

I hope in a few months you find yourself similarly situation
