They asked me what my wife's birthday was. I told them after being a little confused and then hung up after talking to them a bit longer. I called them back because I thought "how could my wife's bill be on my credit" and when I asked that they told me that since we're married it's part of my debt as well? It is certainly an account under my wife's name. It was a medical bill (anesthesia). The original account should most certainly be in her name.

Ok I ended up finding the practice that she was treated at and called them. I figured it would be best to try and get some documentation from them as supporting documents for a dispute. At first they tried to tell me that since I'm her husband I'm responsible until I rattled off about her being the patient for the account and her holding the insurance and that I was not involved at any portion. Suddenly the rep got very cooperative and is mailing out the bill that shows my wife as the patient, our (her) insurance at the time, what insurance paid and what my wife was responsible for.

Hopefully this will be good supporting material to send with the dispute?

Ok, I received the documents in the mail Saturday. It shows my wife as the patient, it states the Guarantor Employer as the company my wife works for. I think this should be sufficient in showing that this account should be removed from my credit?

September 3, 2013

CA Name and address

To Whom it may concern,

This is a Notice of Direct Dispute with you, Fidelity Collections, under the provisions of FCRA §623(a)(8)(D), of the accuracy of information you have reported to my credit file.

This is a direct dispute of credit reporting. This is not a request for debt validation/verification under FDCPA §809(b)

In compliance with FCRA §623(a)(8)(D), and enacting regulations published at 16 CFR § 660.4, this Notice of Direct dispute includes:

You report account # 36123** (original creditor NAME LISTED HERE) to the credit reporting agencies showing this collection as paid in full.

I am not the patient treated in this statement, nor am I employed for PATIENT EMPLOYER or carrier of the medical insurance that was used for this account. The itemized statement attached shows the correct patient name (PATIENT NAME) and the correct guarantor employer (PATIENT EMPLOYER).

Please review the attached documentation , itemized medical statement, Transunion report, and Experian report. I request that the trade lines from my credit report be promptly deleted from all three credit reporting agencies (Trans-Union, Equifax, and Experian).

Under the provisions of FCRA 623(a)(8)(E), you have the duty to review all of the information in this Notice of Dispute, to complete your investigation, and report back to me the results of your investigation, within 30-days of my Notice of Dispute.

Sincerely

James

I was going through my reports to pull the pages to include with the letter.

It only reports on Experian. Should I change the wording on the letter at all since that's the only one that it's on? Just state to remove it from Experian? I don't want to call out Experian only and then it show up on the others in the future.

I would just say to remove from all of the CRAs and leave it at that. And send a copy of that report from EX. You don't need to send all three.

Well I recevied a letter from them today.

Basically the letter tells me that in Ohio a husband is responsible for his spouses medical necessities? That the report they sent is accurate stating that it was paid in full and closed.

This is odd though. I pulled my wife's reports this week and nothing from this company is on any of her reports. She also has a few collections that are paid in full on her account for medical but those aren't showing on my account?

Is it because I paid her collection that they threw it on my credit?

If it is her insurance in her name and you are a beneficary, how in the world can you be responsible.

Did the CA send you that letter?

Correct, her insurance and I am a beneficiary. The paper work I sent showed her as the patient and her place of exployment carrying the insurance.

This was sent back from the CA.
