    <description>As re your JC Penny/Sherman account, I'm 99% sure that before they can begin to report, they have to notify you in writing and give you the chance to dispute the account/information.&lt;BR /&gt;&lt;BR /&gt;Someone else will more than likely chime in on the legalities ... but I'm pretty sure they can't just report right off the bat. If you don't actually have the $$ to pay them off NOW, I'd wait until they contact you and then pay them.&lt;BR /&gt;&lt;BR /&gt;Again, someone else might chime in (hoping they do -- nowadays, my head's full of other stuff -- like swim team practices, karate classes, pasta potluck dinners, etc) with another POV.</description>

      <description>&lt;DIV&gt;Sent it PFD.&amp;nbsp; They are calling my parents home asking me to call them back everyday multiple times per day.&amp;nbsp; In my letter it says to write back to me if they accept.&amp;nbsp; However I did not tell them to stop calling.&amp;nbsp; Not sure how they got my old home address though.&amp;nbsp; The 15 day mark is Sept. 23rd.&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Any suggestions?&amp;nbsp; Should I call them back?&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;&lt;/DIV&gt;&lt;DIV&gt;I decided not to call them.&amp;nbsp; I really want them to stop calling my parents home.&amp;nbsp; No one is there during the day and by then time they get home its almost 9pm.&amp;nbsp; They just leave messages on the voicemail telling me to call them.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;They are not on my CR.&amp;nbsp; Its for a Target card and I tried several times to contact them but they kept sending me back to the CA (NARS).&amp;nbsp; The CA is not listed on my CR at this time but they have done a Inquiry so I would htink that it would be on there soon.&amp;nbsp; I just realized that it made no sense to send a PFD since its not on my CR.&amp;nbsp; Let me go double check.&amp;nbsp; I am an idiot....its not on my CR....I am sure it will be soon.&amp;nbsp;&amp;nbsp; Now what do I do?&amp;nbsp; Call Target again make them talk to me?&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;The last time I made a payment to Target would have been June or July of 07.&lt;/DIV&gt;&lt;BR /&gt;&lt;BR /&gt;Message Edited by aquatic1 on &lt;SPAN class="date_text"&gt;09-16-2008&lt;/SPAN&gt; &lt;SPAN class="time_text"&gt;10:10 AM&lt;/SPAN&gt;</description>

      <description>I hate to sound like a jerk, but something to bear in mind when saving up for the pay-off:&lt;BR /&gt;&lt;BR /&gt;Since you'll be DVing them (and cluing them onto the fact that you understand FACTA and FDCPA), and I'm going to assume that the SoL hasn't run out yet, so be prepared for them to file suit against you. I'm not saying they WILL, I'm only saying be prepared for it and by the time 30 days rolls around, have a plan of action.&lt;BR /&gt;&lt;BR /&gt;Best of luck!!!</description>

      <description>&lt;DIV&gt;I thought about that as well.&amp;nbsp; I did find out additional information.&amp;nbsp; I was able to call Target and was told they had sold the account to NARS last month.&amp;nbsp; That is why its not showing on&amp;nbsp;my credit report yet.&amp;nbsp; They said it can take 30-45 days.&amp;nbsp; &amp;nbsp;NARS sent me a settlement offer I am assuming right away.&amp;nbsp;&amp;nbsp;I have not heard from them in writing concerning my PFD.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I also called my other CC company (JCPenney) and&amp;nbsp;found out they just sold my account to a CA called Sherman Financial they did this&amp;nbsp;the last week of Aug.).&amp;nbsp; I am going to look this&amp;nbsp;company&amp;nbsp;up to find out what they are all about and also I guess&amp;nbsp;wait for it to appear&amp;nbsp;on my CR.&amp;nbsp; Do you think I should contact them&amp;nbsp;now to see if they will agree to a pay-off&amp;nbsp;so that they will not report it?&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;In total between the two bills they amount&amp;nbsp;to about $1100.&lt;img id="smileysad" class="emoticon emoticon-smileysad" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-sad.gif" alt="Smiley Sad" title="Smiley Sad" /&gt;&amp;nbsp;&lt;/DIV&gt;</description>

I recall that these two CA are some of the worse to deal with. I really need to deal with this fast. I tell you if its one thing....its another</description>

      <description>&lt;DIV&gt;Anoither fly in the ointment.&lt;/DIV&gt;&lt;DIV&gt;In many instances, once you send a&amp;nbsp;payment offer to a CA, then under some state laws, that offer may reset the SOL.&lt;/DIV&gt;&lt;DIV&gt;Just a good reason for never talking to a CA or making any negotiation until the debt has been validated and agreed to as a valid liability.&lt;/DIV&gt;&lt;DIV&gt;If you sent them a PFD offer, or any&amp;nbsp;negotiation for payment, before you DV'd them with no admission of the debt, them I would look seriously at my state SOL law as my immediate, next step.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;Almost everything that I have on my credit report is within SOL.&amp;nbsp; Paid collection accounts stay on my report for 5 years (I live in New York&amp;nbsp;State).&amp;nbsp; Literally everything went&amp;nbsp;into collections within two months of each other (Most in 2007) with the exception of a few medical bills from 2005.&amp;nbsp; So my only options are to pay them off and try to PFD.&amp;nbsp;&amp;nbsp;&amp;nbsp;&lt;/DIV&gt;</description>
