I need HELP HELP HELP!!

I have a new collection with Online Collections out of Winterville NC. This is actually the 2nd or 3rd CA that has had this one. I had been making payments to the OC on this one and they were updating the CA. It was sent to the current CA in September.

Here's my problem...

The current CA, Online Collections, mailed me the first dunning notice dated 10/02/2013. I didn't get it until mid-late Oct, around the 20-25th irrelevant but still.

I mailed out a DV notice to the right away.

They signed for it 10/28/2013.

They reported 11/01/2013.

They mailed out the validation 11/15/2013.

They tell me they didn't report until 11/25/2013, Equifax says they show 11/25/2013 but they can only how me the most current, updated date.

I received a myFICO alert 11/01/2013 showing a new collection.

I received another myFICO alert 11/27/2013 showing a new collection.

I have a report I pulled from Equifax 11/04/2013 showing the collection and it is listed as disputed.

They reported BEFORE they validated. I thought this was illegal?

A rep from the CA calls me a few times a week, if not daily and she started getting really crappy with me and I told her that if she wanted to have a civilized, professional conversation we could continue, if not I wasn't going to listen to her be rude and hateful with a bad attitude. She toned it down briefly. In the end she ended up hanging up on me. I called back to speak to a supervisor and luck of the draw she must have happen to answer and she hung up on me again. I called back and spoke to a supervisor and got no where.

I told them that I have no problem paying if they agree to delete, they refuse.

Any input on this. Am I totally misinformed? Can they report after they receive the request for validation and before they validate?

This sent my day down the toilet, totally put me in a horrible mood.

Hi Shellie, for one, they were not allowed to report to the CRA as the DV was timely. I would call the OC and find out as to why they sent your account that you were paying on to a CA.

Hi Shellie, for one, they were not allowed to report to the CRA as the DV was timely. I would call the OC and find out as to why they sent your account that you were paying on to a CA. I would file a complaint with the CFPB against the CA for violation of the FCRA.

I wasn't on a pay schedule or anything. I was just making payments as I had some extra money to do so. While I was making payments it was already with the 1st or 2nd CA, and was already reported by Convergent. Online Collections just got the file in September. I was still able to go online to the OC and make payments directly to them.

I have found everything but the validation. I have the original dunning notice, the signed card from the DV letter, copies of the alerts from myFICO and copies from all 3 CRA dated 11/04/2013 showing the TL and that it was disputed. I will keep looking for the stinking Validation that I received so I can have proof of the date. I don't want to proceed until I have that so they can go back and just change the dates in their system to show a date that helps their case.

I plan on paying the OC and not the CA. I will be trying to pay them in the next couple weeks.

So uh...I got a letter from Portfolio today. It's for the same collection mentioned in this thread, I think. I states on the letter that it is for the same company but the dollar amount are different. I says they bought it on 05/25/2012. I don't think I had another account with the same OC that they could be collecting on. It states on the back of the envelope "Because of the age of your debt, we will not sue you for it and we will not report to any credit reporting agency." It's on of those heavy papers that folds into it's own envelope?

I am beyond confused right now.

If its for the same account somebody qould be in trouble. your paying the OC for an account they sold to a CA? Id definately be asking questions of someone.

Just two. Convergent is no longer reporting. Online Collections is reporting. The letter from Portfolio I don't know what it's about. It's the same OC. The amounts are different. I really have no information. The last like 2 numbers are the same but the rest aren't. I don't know if the account number that Portfolio listed is from the OC or just the number that Portfolio assigned?

Definitely send the newest CA, Portfolio, a DV.

I think a CA uses a combined account number, part of theirs and part of the OCs.

And, I would just contact the OC and ask them what other collection they have for you, besides the one you were paying on. If they don't have another, then something is definitely not right.

How would it prompt additional actions? Especially if the CA says it is outside of SOL.

As for the initial post about the CA and the DV, they said they reported before the DV. From another post about the same thing, did you get an alert on 11/1 about a new collections?

Which means they reported before validating which is a violation. Your recourse would be to sue them or file a complaint with the CFPB and ask for them to remove it.

They are saying they didn't report the first time until 11/25/2013. They are claiming that they posted after they repressed to the DV. I have reports from 11/04 showing it and showing it disputed.

I can't find the response at home. I've misplaced it some where. Praying one of the kids didn't throw it away not knowing any better. I wanted to have that in hand with the date on it so I can have absolute proof.

I know. In another thread you posted the new collections from, I believe SW, showing it being reported 11/1. That should be enough to help you, and the reports that show it also.

It won't hurt anything to try.

It would cost the upfront filing fee to sue them. You have all your paperwork clearly showing the dates.

I printed off screen shots showing the SW alerts that are dated. Yes this is the one I was talking about in another post. I just happen to get into a stinking argument with them and had more info so I made a second post.

I'm not paying them! I can still pay the OC and that's what Iplan to do.

Suing the CA for a FDCPA violation? $1000, to you, for each offense I believe.

And the fact they are clearly wrong. Your state AG could possibly do something to them also.
