Hey Guys - Hoping for some advice on how to handle/tackle a debt that's just been transferred/purchased by Midland. The original debt was a CC from Citi. At the moment I'm not sure when it went deliquent or much info there - I've gotta try and find some old credit reports or possibly some info I may have stashed. The only info I do know is this: Asset Acceptance filed a judgment agaisnt me in 2011, this is what my Experian report says (as of Jan-2014):

Type: Judgment
Date Filed: 10/2011
Case Number: ********
Court Number/Name:
Court Address: 4000 Chain Bridge Rd
Fairfax , VA 220304017
Plaintiff: ASSET ACCEPTANCE LLC
Defendant: *******
Amount: $939
Status:
Date Reported: N/A
Satisfied Date:
Verified Date:
Comments:

The debt only shows up on either Experian or Equifax as a judgement.

Back in April of 2013, I decided to try and start paying some debts so I joined a DMP through CareOne. They listed my balance with Asset Acceptance at around $1200. I made payments of $25/month per my DMP agreement (which they never officially "accepted" apparently. I was told this was okay though). My current balance should be about $950 or so.

First I'd like to get as much paperwork/info about this as possible. How should I go about getting this from Asset Acceptance and/or Midland (since it's now in Midlands hands)? I don't wanna say the wrong thing, or get myself in more trouble for mis-speaking/etc. Any help?

EDIT: I'd also like to point out that I may also attempt to vacate this judgement on grounds of mis-service (not sure of the correct words). I spoke with the clerk and she wasn't able to give much info, but did confirm the address they had for serving the warrant in debt was an apartment I hadn't lived in for 2-3 years. I was never aware of the warrant/judgement until I found it on my CR.

You could possibly get it vacated for improper service of notice. Id say you have a better than average chance. if you do they'll have to remove it from your CR until such time as it gets refiled IF the CA decides to do so.

Yea, I'm hoping I can get it vacated! I want to get it satisfied first though. Vacating will be a pain since I now live in Southern VA, so I'll have to make a trip back to NoVA to get all the details.

If it's midland and you go for a vacate be prepared to be served again. They're not the easiest to work with and they'll try pretty hard to not be accommodating in any way.

Check your state law regarding period for asserting inaccuracy in the judgment, such as lack of proper service.

There may be a period after becoming aware of the matter in which to file.

In the mean time I want/need to contact Midland in regards to the debt. I called Asset Acceptance (the original CA) to see if they could give me any info, but they said no and hung up. Since Asset Acceptance was the original CA, and the agency listed on the judgement, what should I expect from Midland? I want to make a settlement offer/etc. I assume I should request, in writing, a judgement satisfaction letter? I'm really not sure how to handle it since there was/is a judgement...

If you need documentation of the judgment itself, go to the clerks of the court where the judgment was filed and they will have everything on it.

And for what it is worth, Midland bought out Asset several months ago.

Hi there,

I have the same issue... a judgment that was with Asset Acceptance, bought now by Midland. I contacted the lawyer on the court documents which i found online. i emailed the gentlemen expressing my desire to discuss the judgment. He responded back saying he no longer would be able to discuss any judgment from Asset Acceptance, and sent my request to the parties involved. I now have the 2 direct email address for the lawyers that work for Midland. I have contacted them and am now waiting for them to respond. I will let you know what happens.

Good Luck!
