one step forward, 2 steps back

Ugh!!!!!

Trying to get our credit in line, so we can get married debt free and refi our new home together (in 3 years).

Well, I pulled EQ and TR CRs for my fiance. mailed 2 GW letters yesterday and 2 PFD, in another 2 weeks to a month we plan to mail 2 more PFDS, waiting for another baddie to expire in Feb...seems like we are making some headway right? WRONG.

He has 4 medical collections...3 from a car accident. Plan to PFD (unless someone knows of a better idea) in 4-5 months. Well, the 4th one is $650 from a dentist. My fiance had his wisdom teeth pulled by the dentist he was working for at the time....free of charge since he was an employee. It was done during his employment in 1999.

Well, as of June 2008 the "account" has been reported to collection.

What is our best course of action?? Should we DV? Call the dentist office (it's been sent to collection)?

I can't believe this. Any advice is appreciated.

Use the hippa process for the med collections, I however am not an expert on this so maybe someone can provide further assistance after you have read this.

As for the dental collection, I would start with sending a letter to the office explaining the situation. I would hope you wouldn't have to go any further than asking them to delete.

That's why we are confused.

SInce he worked there when the procedure was done, it was free. I'm guessing that they may have a new person doing the books and they reported this to CA, not knowing why he never paid a single penny.

Should we just call the office?

I had something similar (not medical tho) and the CA told me, not to bother with the office because it was up to the CA to delete. But in his case, this should never have been reported at all.

If he ended his employment in good status with the dentist/employer, I would call and speak to someone there about it....even the dentist, if necessary.

I just ordered his TR and EX from myFico.

DIsputed online with EX mailing letter to TR. Reason for dispute: "i was an employee of Dr. ALbright's and the procedure was done free of charge."

Lets count to 30 (or 45) and see what happens.

Meanwhile, his next day off is Friday...looks like he has a phone call to make.

If the procedure was performed in 1999 it is past CRTP.

We don't have any original reciepts (since there was never a charge) so we do not have proof of the date of procedure.

My fiance left the dentist's office on good terms, with an offer to come back so we don't want to burn any bridges. But what is our best course of action now? We are going to try a phone call, I'm hoping Dr.Albright got a new accountant or secretary who made a mistake and Dr.Albright will remove it ASAP.

Well, I don't know about you but it looks as if someone already threw the match on this one. Guess the financial crisis is getting to everyone.

Hey, did your state's debt collection SOL's expire on this? Was your fiance living at the same address since 1999? Same telephone number since 1999? Could bring up the why no contact question.

TX SOL is 4years on all types of accounts (to my knowledge)

Changed address, changed numbers (got divorced).

You are right though, someone lit the match.

Ugh, dang economic crisis.....the Zombies are coming out for sure.

Well, I will say this. If he got divorced and moved out then he may have gotten billed. The main thing is that you said your state's SOL is 4 years.

You can call and ask them about why they are billing him for the "Free" procedures and by the way, the statute of limitations has expired on this debt so they will be getting a Cease and Desist letter by mail in a day or so.

got a copy of his EQ report in the mail today.

One of the paid accounts we sent GW letter to has deleted the account completely (but it's still on TR and EX, waiting patiently) and the dispute we filed against Sarma CA for his wisdom teeth removal has been deleted as fraud.

YAY!!! slowly making progress.

This is the real reason people hate dentists!!!!

EQ deleted this account based on fraud. (thank you EQ)

However, the account is still on TU and EX. I sent a DV to the CA. based on the green card, it was signed for on 1/23/09.....we have yet to recieve anything from them. TU reporting date was updated to Feb 2, 2009.

If they do not contact us within the next few days what should I do?

We tried playing nice and called the dentist's office. The receptionist was very rude and directed us to call the CA. We do not have a phone number for the CA since the only info we have is from CRs. That's when we sent the DV. We live in TX and the procedure was done close to 10 yrs ago. SOL in TX is 4yrs.

Please help!

That is what is now listed on his CR. How long should I wait for response to the DV before contacting the CA again? Should I DV the OC?

Someone please help. This situation is kinda weird, i know. Thanks in advance for any feedback you could provide.
