ACS INC Debt Collectors or Scam?

Okay back in 2008 or 2009 my husband took out a payday loan for 700 dollars I was unaware of this. So about 3 weeks ago he gets a phone call saying if he does not pay he will be sued taking to court blah blah. He is frightened still at this Point I am unaware of what is going on. So he finally tells me that he took out this payday loan a while back and that he has given them access to our bank account I could not believe he had done that so I tell him he should have gotten to validate the debt first and sent him paper work stating how much he owes etc.. he calls them they say the will sent it this is before the received the money, but we never receive anything and yes the have their money. Any advice as to what I should do?

A DV request has to be made in writing, and once it's made, there's no time limit for them to respond. If it's already been paid, and there's no disagreement on the balance owed, I'd move on but keep an eye just in case they report post-payment. If paid and having second thoughts on the balance, mail a DV CMRRR and see what they say. If they just show a balance (as required), then write back asking for an accounting of how they came to $x and reconcile it from there.

ETA...as to whether or not it's a scam, I never heard of them. Doesn't mean that they are not legit though. If they read off facts and info to DH, then they are likely a legit CA.

Threats to take legal action are a violation of the FDCPA if they cant or dont intend to do so. That is a tough nut to crack..... proving lack of intent on their part.

I would first put togther your options, beginning with an evaluation of the SOL status of the debt. In some states, payment or firm offers to pay can reset the SOL.

Giving banking information would seem to imply consent to pay.

I would suggest digging up a copy of your state SOL statute, and determine when the debt will become legally uncollectible.

DV requests only result in impostition of a cease collection bar if sent within 30 days of their dunning notice. When did they send dunning notice?

They did not , they called him over the phone no letters are anything he did say they knew where he worked and where he lived which kinda puzzled me as to why no letters or anything sent to our address. See I would not be as worried as much if he did not agree to pay them more he borrowed 700 but they want him to pay 1200 300 up front 200 for the next 6mos.

That place is a scam!!! Let them take you to court don't pay them anything!!! That "company" is known for fraud they send emails to people saying they owe money and will be prosecuted. I have applied for loans in the past but never went through with it. Do not deal with those people, & if you do hire a lawyer. They do not even know how to spell correctly its a scam.

Most payday loans that I know of require you to write the company a check for the amount they are lending you. If you do not return to pay it off, they cash your check to receive their money back. I'm not sure how it would still be money owed then... so it very well could be a scam. Also, they can claim to know where you live or work - but make them prove it. Tell them they need to send you any offer in the mail (but do not give them your address) so that you have it in writing.

Do not make any payments to them!!!! Not until you figure out if this is a scam or legit - then you can go from there.

Yes, if you google ACS they are a scam.

There are many, many examples of the email that is sent out by the scammer on ripoffreport. You can see the whole email - there is no attempt to disguise the fact that they are bringing criminal charges and want you to send money within X hours via Western Union or one of those money pac type cards.

Check it out. Don't send any more funds. Get in touch with your bank. You probably need to change accounts at a minimum. You might need to file a police report.

I recieved and email from the Company ACS INC, I knew I did owe anything so I called them, this company is FAKE!!!!!!!!! When I advised them that I would be reporting them to the BBB they hung up on me and I tried calling them back. They dont care that they are trying to scam people he told me okay report me and what do you think is going to really happen. I was completely loss for words. I hope the telephone number was not 1-347-571-9007. They also have an email address to reply back to THE FOOLERY OF PEOPLE!!!!!!!!!!!!

They also call from this number too - 716-616-9886. I ignore them totally. I changed banks and they don't have access. Definitely close your accounts.

Back in 2012 I made the mistake of taking a payday loan and it went through, ok that matter was resolved, fees were paid and everything. This is the time 2 years later that I keep getting phone calls about a "complaint that was filed against me", emails from ACS and this phone numbers you mentioned. I'm so over this people. I tell them it was resolved and why did you wait 2 years to charge me, why wait so long? Lol it seems it's hard to get rid of these people. They have no regard for peoples health, the first time they called me back in 2012 after I know I paid back I almost got a anxiety attack because "I didn't want to be persecuted" come on not even the IRS can prosecute you without first giving you a Chance to pay. These people are sick, back then I blocked my bank account and I just unblocked it to pay them back and then I closed it. If you are so legit you should have my actual address and be able to mail me final letters.

LOL - from a gmail addy???? Now THATS funny right there. Geez there is so much wrong here....

1. They have not sent you a legal dunning notice, only a threatening email.

2. They have overtly threatened criminal action which is itself a FDCPA violation:

(1) VIOLATION OF FEDERAL BANKING REGULATION

(2) COLLATERAL CHECK FRAUD

(3) THEFT BY DECEPTION

This has scam written all over it. Until they send you a LEGAL dunning notice, tell them to go pound sand.

I received this exact e mail. I questioned them by e mail as I have applied recently for a loan on line, but they were all fraudulant so I never got one. However I was not thinking and put my SSN and bank acct # on one that was going to direct deposit to my account. Of course they never did and I was so mad at myself for putting that out there. I called the "company". The man who answered could not even tell me who the "loan" was from. He finally said it was in July . I had a $300 cash deposit in August, but at that time I had just sold a house and had never even thought of applying for a loan. This makes me think they were able to somehow get into my account and see this deposit!?!?! I have no idea. The man who answered could barely speak english and said he would be taking me to the courthouse if I did not pay. Really?? Then I read back through the email and saw all the gramatical and tense and basic punctuation errors. I believe these swindlers have just enough information from the application to appear that they are valid. I told him to ....well never mind. I do not expect to receive a summons to go to the courthouse, but I will never put my info out like that again. I will just drive to the bank for a loan.

i just recieved an email from acs inc. They said they ran my s.s. number and found i was never sued for fraud. they stated a débt of over $1000. they never stated whom they were representing nor ever acknoleged me by name. theletter started as dear debtor. Where should i take this. my lawyer said no good can come from responding. As they dont have my name or address. just a vauge emeil.

I would make a copy ot the email then prompty delete it. You are only keeping the email as evidence should you need to sue. Its most suredly a scam I get more scam emails than legit anymore... Legit collectors will make first contact by mail or phone not email..

Anything sent via Email regarding delinquent debt is a scam.
