    <description>&lt;P&gt;Hi there,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I am not certain if when you "settle" an account constitutes as account being brought current. If that is the case, then Equifax rep may have a point. I didn't see anything on the original post that showed that the account was settled just that it was updated in 2008.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Maybe someone more familiar with the FCRA can chime in as well. But the way I understand it is that if the account was never brought to current, then the original DOFD still applies.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Best of luck&lt;/P&gt;</description>

      <title>DOFD or Last Day of Activity Question - Need Advice</title>

      <description>&lt;P&gt;Hello group,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I just spent about an hour on the phone with a representative from Equifax where I was questioning when some old charge offs will fall off my report. and when they will fall off. Clearly on the report it has the first day of delinquency is 8/2007 but he said they are going by the last day of activity which is 9/2008. Where as it should fall off this year he saying it wont fall off until next year and he doesn't see the information that I am seeing. I am like it is your report of which I gave you the confirmation number. He said that Chase updated the information and that I need to contact chase. As a kind gesture he is going to send me a new report for my review so I can see what he sees.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;it is in black and white....what should I do? Should I let the CO sit on my report for another year when it should come off this year. then he said they go by date of last activity not date of first delinquency as far a removal calculation. DOLA has absolutely no bearing on the time how long an old debt&amp;nbsp; remains on your report. You need to see if there was ever any updates between 08/2007 and 09/2008. If the account was never brought back to current, then you can send a dispute letter to the CRA citing FCRA 605(c) which clearly defines that the account can be on your credit report no later than 7 years + 180 days from the commencement of the delinquency.&lt;/P&gt;</description>

One thing about me and it is probably terrible, when I stop paying I stop paying everything not one here or one there I just stop it all so I can catch my breath so to speak and 2007-2008 was pure hell for me. I have kept all of my PIF letters so I will have to go through it and see what was done at that time but I am sure I treated both the same.&amp;nbsp;&lt;BR /&gt;&lt;BR /&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The account history listed is as followed:&amp;nbsp;&lt;/P&gt;&lt;P&gt;2/09 - 4&lt;/P&gt;&lt;P&gt;1/09 - 4&lt;/P&gt;&lt;P&gt;12/08 - 4&lt;/P&gt;&lt;P&gt;11/08 - 4&lt;/P&gt;&lt;P&gt;10/08 - 4&lt;/P&gt;&lt;P&gt;9/08 - 2&lt;/P&gt;&lt;P&gt;8/ 08 -1&lt;/P&gt;&lt;P&gt;11/07- 2&lt;/P&gt;&lt;P&gt;10/07 - 3&lt;/P&gt;&lt;P&gt;&amp;nbsp;9/07 -2&lt;/P&gt;&lt;P&gt;8/07 -1&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;That is all that is listed...he said he didn't see the listing from 2007 only from 2008. And on Trans Union it has DOFD 5/2007...so confusing.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The other Chase had listings for evey month with no spaces.....thanks again for your feedback.&amp;nbsp;&lt;/P&gt;</description>

EQ does attempt to use the DOLA for CRTP and they are wrong, if they refuse to budge file a CFPB complaint on EQ.&lt;/P&gt;</description>
