ACS is a scam. They aren't even real debt collectors. They are scammers operating outside of the country using intimidation tactics to get you to pay them for a 'debt' you may or may not owe. As you found out, even if you have a payday loan outstanding, if you pay ACS none of the payment you make will go toward the outstanding debt.

Post the email you received from ACS here (leaving off your specific personal info) and we can point out the specific phrases showing how to recognize the scam.

Best to just cancel your card (as you did). Report them to the FTC. In fact, you can read all about this scam at the FTC.gov site under consumer scams (this one is the Payday Loan Collection scam).

Best to contact the payday lender directly if you want to pay off the debt.

I apologize this may be long winded, but appreciate your opinions. So I almost paid them, because they said they were collecting on a legitamate debt of mine- but after some research it seems they are a scam. Doing a litlle more digging I called the OC who is a payday lender and they sold it a different debt collector. Upon this knowledge I immediatly cancelled my debit card and called them for more information. I mentioned that I would need something in writing in order to arrange payment. upon hearing this they transferred me around and the last woman became beligerent when I explained to her that I wanted to request verification, and that I needed their address. She was constantly trying to talk over me, and simply would not give up an adrdress saying that she didn't have to and that she wasn't authorized too. Instead she offered an email verification which basically stated nothing, and also did not have an address for the company. Citing an email address attached to a website that doesn't exist. Now they keep calling with evasive legal sounding threats. OH I almost forgot I asked them who they purchased the debt from and they "guessed" wrong lol I mean I've pretty much made my mind up on this but if anyone here has any legit experience with them please let me know. thanks for reading.

i feel like its worth mentioning that they did not ask for western union or money pak, they were willing to accept a regular card. The only reason I almost fell for this is because the people calling did not sound like typical scammers with broken english and such.

I just wanted to post all this so the information is out there. that letter head could be made very easily by anyone. Just to arm people with knowledge about how they are able to do this.

you apply online for a loan instead of actually recieving a loan instead what you get is a "brokering" service who send out your info to a bunch of places and they do absoloutely no check to verify credentials of these supposed lenders. its safe to assume that since the default rate on payday loans is so high a good percentage of people who's information pass through these brokering sites will eventually end up reported to an agency that keeps track of payday loans, that legitimate( if you want to call them that) payday lenders use to check and make sure you're not overextending on payday loans. with your ssn, address, bank name, phone number they are able to appear as a real lender which is how they find out about your bad debt. with all your information all they then have to do is make vague sounding legal threats and hope you agree to pay them. just be careful who you give your information too, I like to think of myself as educated and they still almost got me, so I can only imagine how many other people they have fooled.

....it also does not include dunning notice requirements mandated under the FDCPA.

If not included in the initial communication, it must have been sent within 5 days after this initial communication.

I would bet that no follow-up dunning notice was sent.

If not, I would advise the CFPB of their violation.
