I made a complaint to the CFPB about a collection account. I received a response from the CA stating they would remove the account from all credit bureaus. This popped back up on my report today, 4 months later. What steps do I take to make sure this goes off and stays off? It's the only negative thing on my report and nose dived my score. I thought this nightmare was over!!!

How did you receive the response? Was it written? Mail? Email? You can contact the CA and nicely request that they delete it once again or you can dispute with the CBs using that statement as proof. was the collection re-sold?

The reinsertion of previously deleted information is regulated under the FCRA only when a deletion has occured as a result of lack of verification in a prior dispute.

See FCRA 611(a)(5)(B).

That procedure requires any reporting of a resinsertion to be accompanied by a Certification of Accuracy before the CRA may reinsert, and if the CRA does rensert, that they must send you specific written notice of their reinsertion within 5 business days. If you never received such notice from the CRA, then the required process was not followed, either because there was no prior FCRA dispute, and thus no reinsertion procision, or the furnisher did not comply with the requirement for Certification of Accuracy.

A complaint to the CFPB is not a dispute under the FCRA, it is an adminisrative complaint of lack of compliance with some provision of the FCRA.

Unless th CFPB specifically issued some injunction based on your complaint, the fact that they deleted after filing of your complaint does not restrict their reinsertion.

You should exercise your dispute rights under the FCRA before filing a complaint, thus letting that process first run its course and then involing the reinsertion reqirements of section 611(a)(5)(B).
