I've noticed that it is not on my non-CO'd CapOne with a 30 day and 90 day late. It also is not on my repo from Americredit. After 7 yrs from the last late the account would have shed all of its lates and converted to a good account.</description>

      <description>It does show the drop off date...I just started an investigation online...with my TU report...and the drop off date was there on every nogative account...</description>

      <description>&lt;P&gt;My apologies for not being clear and thank you for your time.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It shows on EXP and EQ. Well, EQ has 1 ca and shows DOFD. EXP shows fall off date for 2 and Tu shows nothing for 2 ca's.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;For one of those ca's, EQ and EXP disagree. But at least they report something. I do know for a fact that none are off by 6+ months, but it's odd that TU shows nada. I thought it had to report that at all times. But I guess it is not a violation, it's just shoddy operations by them, right?&lt;BR /&gt;&lt;BR /&gt;Thanks, again.&lt;/P&gt;</description>

      <description>It is unusual that TU lacks the info. I don't think it is mis-reporting by the CA, otherwise EQ and EX would not show those dates too. Maybe it was a TU glitch or something. I'd probably call them.</description>

      <description>&lt;P&gt;I would NEVER rely on a DOFD in my credit report.&lt;/P&gt;&lt;P&gt;Many creditors dont understand what DOFD is.&amp;nbsp; Others know, but will update it to a later DOLA for their own purposes.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The DOFD is clearly defined in the reporting manual accepted by each CRA and provided to each creditor who subscribes for reporting to the CRA.&amp;nbsp; It is in compliance with the FCRA.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The first reporting of a DOFD occurs 30 days from the due date of&amp;nbsp;the bill that was not timely paid.&amp;nbsp;&amp;nbsp; That is a sticky date in the credit file that remains unchanged until overridden, and is stored under a separately reported code called the "FCRA Compliance Date."&amp;nbsp; Very specific guidelines govern when this date can be updated.&lt;/P&gt;&lt;P&gt;It cannot be updated by any consecutive 60/90/120+ later delinquency in that chain.&amp;nbsp; Nor can it be updated by any payments that do not bring the account back into good standing.&amp;nbsp; That includes any offers to pay, CO or CA entries on the account, etc.&lt;/P&gt;&lt;P&gt;The DOFD/FCRA compliance date can ONLY be updated IF the account is still open, and brought back into good standing, AND then a new, first delinquency occurs in a new chain of delinquencies.&amp;nbsp; Then, and only then, can an OC report an update of the old DOFD.&amp;nbsp; Then the process just repeats.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So all you need to know to determine the real DOFD/FCRA compliance date that should be in your credit file are your account billing records.&amp;nbsp; For any account, it is 30 days from the due date of the first bill that became delinquent in the most recent chain of delinquencies on that account.&amp;nbsp;&lt;/P&gt;&lt;P&gt;If the CRA is reporting a different date, simply dispute it with the CRA, using your account records as support.&lt;/P&gt;&lt;P&gt;I think that it is a common misconception that the commercial CRs we buy constitute our credit file.&amp;nbsp; They are only a summary, and often dont report many items, such as DOFD/FCRA Compliance Date, that are a part of your credit file.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As an example, the FCRA fallof date for derogs is normally 7&amp;nbsp; or 7 1/2 years, which governs what the FCRA permits most creditors to obtain from a CR generated from our credit file.&amp;nbsp; However, the FCRA has an exemption for these falloff dates for any credit application that is for $150,000 or more (FCRA 605(b)), such as most mortgqge loans.&amp;nbsp;&amp;nbsp;&amp;nbsp; Thus,they can request and receive a CR that includes prior derogs that are in your file beyond the normal 7-71/2 dropoff.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;DIV class="message-edit-history"&gt;&lt;SPAN class="edit-author"&gt;Message Edited by RobertEG on &lt;/SPAN&gt;&lt;SPAN class="local-date"&gt;10-28-2008&lt;/SPAN&gt;&lt;SPAN class="local-time"&gt; 12:25 AM&lt;/SPAN&gt;&lt;/DIV&gt;&lt;DIV class="message-edit-history"&gt;&lt;SPAN class="edit-author"&gt;Message Edited by RobertEG on &lt;/SPAN&gt;&lt;SPAN class="local-date"&gt;10-28-2008&lt;/SPAN&gt;&lt;SPAN class="local-time"&gt; 12:40 AM&lt;/SPAN&gt;&lt;/DIV&gt;</description>

      <description>&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;Hmmmm.&amp;nbsp; Here is how you catch them.&lt;/P&gt;&lt;P&gt;&lt;BR /&gt;Section 623(a)(5)(A) of the FCRA requires that a CA must report to the CRA, within 90 days of first posting a CA on your CR, their date of delinquency being used in their collection activities on the account, which "shall be the the month and year of the commencement of the delinquency on the account that immediately preceded the action."&amp;nbsp; That is the DOFD with the OC, not their later CA dates.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The credit reports you get from all the commercial vendors, inccluding myFICO, are just a summary of your credit file.&amp;nbsp; They dont routinely report these dates, but you can get them from the CRA,&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If you want to know the DOFD that is in your credit file, you have the right to request, at any time, directly with the CRA,&amp;nbsp;"all information in the consuner's file at the time of the request."&amp;nbsp; FCRA 609(a)(1).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So I would send the CRA a request under section 609(a)(1) of the FCRA for the following two pieces of data embedded in your credit file:&lt;/P&gt;&lt;P&gt;1.&amp;nbsp; The current "FCRA Compliance Date" as reported by the OC (&lt;EM&gt;ask for "Base Segment Field 25" entry&lt;/EM&gt;), and&lt;/P&gt;&lt;P&gt;2.&amp;nbsp; The date reported by the CA in compliance with FCRA under section 609(a)(1).&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Both should be the DOFD with the OC.&amp;nbsp; If those dates dont match, that is how you can prove illegal CA reaging of their collection activities.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;DIV class="message-edit-history"&gt;&lt;SPAN class="edit-author"&gt;Message Edited by RobertEG on &lt;/SPAN&gt;&lt;SPAN class="local-date"&gt;11-19-2008&lt;/SPAN&gt;&lt;SPAN class="local-time"&gt; 12:20 AM&lt;/SPAN&gt;&lt;/DIV&gt;</description>

      <description>&lt;P&gt;Robert&amp;gt;&amp;gt;Thanks. I actually sent TU a dispute but didn't name that part of the FCRA. They sent back "contact the creditor" and told me to kiss off.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I know Experian reports fall off 2/11 for one of my last ca's when it should be 5/11. Love that, too! I'll send those letters if I have other issues. For now, I am focused on waiting for the 30 day dv window to expire for those 2 ca's.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;PS. Actually, I'll send that anyway. Great job as usual.
