What do you mean non permissable? Did you have an account assigned to calavary? If so, then the inquiry is legitimate. If you dont have an account with them and they pulled your report in error due to faulty skip trace, you can request them to delete it.

Although the collection account may not be on file, that wont stop the collection agency to pursue collections. Since the account is old from 1996, the SOL is in your favor. But keep in mind, as long as they own your account, they do have permissable purpose.

jose,

is the inquiry visible to others or not?

an account over 10 years old is no permissible purpose for a credit inquiry visible to others. inquiries visible to others are permissible only for collection of open\active accounts by the original creditor or new credit applications.

did you send a DV letter to this collector? if you didn't you should.

did you complain to the AGs, FTC and BBB for this non-PP inquiry?

after a non-pp letter, i would also send an ITS letter and possibly sue in Small Claim.

I would also send a request for investigation into this inquiry to the CRA - if they do not immediately update the record showing investigation in process you can also complain to the AGs, FTC and BBB for failure to investigate by the CRA.

This years I have filed 4 suits against CAs for non-PP inquiries - some have been settled and i can't get into the details. However, I have no CA inquiries on my current credit reports.

good luck!!

Message Edited by demed on 12-06-2008 04:36 AM
