call from a collection agency

So I received a call from a collection agency apparently about a debt from 9/2008 .
I told them 8 wanted a debt validation letter and they didn't know what I was talking about. They thought I was going to pay the debt and that a debt validation letter was them sending me a letter saying I've paid.

I asked if they had a website, they said yes just go to the secretary of state website and look them up and their info would be there.

I told them I would look into it.

The number they called me from does not pull up anything in a search. (303-731-6286)

A real collection agency would know what a DV letter is, and would know the laws.

This sounds like someone just waiting to be sued. I would report that phone number if it doesn't come up.

I would find their info at the state level like they suggest and mail them a DV letter its possible they are legit.

If they called regarding payment of an alleged debt, wouldn't you want to wait 5 days for the dunning letter before DV'ing them?

My guess is that the call was from a foreign country that hacked this phone # to try and scam people into paying. I had this happen to me, I called the # back and was informed that they were aware of the scam and had reported it, It was also a lawyers office phone #.

If you know who they are there is no reason to wait for a dunning letter, thats just me. Some may choose to wait for the letter but if its an older one dunning may have been sent long ago and they would not be sending another one.

No reason to wait for dunning notice.

You can send a DV without having received dunning notice, and it will be timely.

Well the first time I tried to call them back a woman answered the phone and said "I'm looking for" and hung up. So I called again and they told me there company was called D2 Management. The original message I received when I missed their call said they were BNG Legal....

I now believe you were being scammed with a spoofed phone number being shown.

Tell them you need their name and address so you can turn this matter over to your attorney. I would not be surprised if the phone goes dead.

They initiated a communication with the consumer, which triggered their requirement to send dunning notice within 5 days.

Part of dunning notice is to identify themselves and provide a communication address to that you can request debt validation.

If they are not sending dunning notice, they are denying you the opportunity to send a DV.

Clear indication that they are not playing by the FDCPA, and thus not a legit debt collector.
