    <description>I'm not applying to anything except for jobs right now. But really I don't feel like in a big rush. I suppose my time could be best spent elsewhere - this just seemed like the quickest to resolve and I suppose it will be even if I just let them fall.</description>

      <title>DV letter for CA reporting bad checks on my CR</title>

      <description>&lt;P&gt;Hi everyone. I am trying to go through my reports piece by piece. I'm starting out with these checks. 2 are being reported by "Account Liquidation Services" as separate listings on my TransUnion CR.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;They are very small amounts - $18 and $7. I was going to try to just PFD but someone suggested I DV first. I found the sample DV letter but it seems more tailored to CA who are trying to collect old credit card bills rather than a returned check. So I guess I need some suggestions on how to word it to be tailored to a check. I highlighted some problem areas. Does anyone have any suggestions on how I might tailor this for my checks?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I will most likely send 2 separate letters since they list the 2 checks as 2 separate listings on my credit report.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Here is the letter, let me know if you think I should make any changes to be more geared towards checks:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;SPAN&gt;&lt;FONT color="#008000"&gt;To Whom It May Concern:&lt;/FONT&gt;&lt;/SPAN&gt;&lt;/P&gt;&lt;SPAN&gt;&lt;FONT color="#008000"&gt;&amp;nbsp;&lt;/FONT&gt;&lt;/SPAN&gt;&lt;P&gt;&lt;BR /&gt;&lt;FONT color="#008000"&gt;This letter is being sent to you in response to a listing on my credit report by Account Liquidation Services. Be advised that this is a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.&lt;/FONT&gt;&lt;/P&gt;&lt;FONT color="#008000"&gt;&amp;nbsp;&lt;/FONT&gt;&lt;P&gt;&lt;BR /&gt;&lt;FONT color="#008000"&gt;This is NOT a request for “verification” or proof of my mailing address, but a request for FULL MEDIA VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that (a) the account is valid, (b) the amount allegedly owed is accurate, and (c) I have a contractual obligation to pay Account Liquidation Services for this alleged debt.&lt;/FONT&gt;&lt;/P&gt;&lt;FONT color="#008000"&gt;&amp;nbsp;&lt;/FONT&gt;&lt;P&gt;&lt;BR /&gt;&lt;FONT color="#008000"&gt;All of the following MUST be provided to adequately validate the authenticity of the alleged debt AND provide proof of my contractual obligation to Account Liquidation Services for this alleged debt:&lt;BR /&gt;• Copy of the original cancelled check, marked as “Insufficient Funds”&lt;BR /&gt;&lt;/FONT&gt;&lt;FONT color="#008000"&gt;&lt;SPAN&gt;&lt;FONT color="#ff0000"&gt;• Copies of all signed vouchers from the date account was opened until default&lt;BR /&gt;• Copies of all statements from the date account opened until default&lt;/FONT&gt;&lt;/SPAN&gt;&lt;BR /&gt;• Proof of the statute of limitations&lt;BR /&gt;• Proof of agreement that you were hired by the Original creditor (creditor as defined by the FDCPA) or&lt;BR /&gt;• A copy of the contract Account Liquidation Services purchased the alleged debt.&lt;BR /&gt;• If the alleged debt was purchased, provide a copy of an agreement between Account Liquidation Services and myself, signed by me, stating that I have a contractual responsibility to Account Liquidation Services for the alleged debt&lt;BR /&gt;&lt;/FONT&gt;&lt;FONT color="#ff0000"&gt;• Provide proof that Account Liquidation Services is bonded/Licensed for debt collecting in the State of Iowa&lt;/FONT&gt;&lt;/P&gt;&lt;P&gt;&lt;FONT color="#008000"&gt;&amp;nbsp;&lt;/FONT&gt;&lt;SPAN&gt;&lt;BR /&gt;&lt;FONT color="#008000"&gt;Be advised that failing to provide ALL of the media requested to validate the alleged debt will invalidate any and all claims Account Liquidation Services is asserting regarding this alleged debt. If Account Liquidation Services cannot provide all of the validation media requested above, ALL collection efforts MUST be stopped and the account MUST be DELETED from the Account Liquidation Services. If you cannot validate your claim, you cannot, by law, collect on it, or SELL it to another collection agency. Also, reporting a debt to the credit reporting agencies that cannot be validated is a violation of the FCRA (Fair Credit Reporting Act), and carries a &lt;STRONG&gt;$2500 fine to be paid to me&lt;/STRONG&gt;. I have two years to decide if I want to pursue this matter. PLEASE GIVE THIS MATTER THE ATTENTION IT DESERVES.&lt;/FONT&gt;&lt;/SPAN&gt;&lt;/P&gt;&lt;P class="MsoNormal"&gt;&lt;BR /&gt;&lt;FONT color="#008000"&gt;If your offices are able to provide all of the validating media as requested, I will require at least 30 days to investigate this information, and during such time, all collection activity must cease and desist.&lt;BR /&gt;I am also stating, in writing, that no telephone contact be made by your offices. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment, and I will have no choice but to file suit. The other bullets aren't appropriate wording for returned checks. I didn't know if I should just remove or if there might be some better verbage to insert there.       <description>I should also note that these are estimated to be removed on 6/2009 and 7/2009. Is it better to just let them fall off or should I proceed with DV?</description>

      <description>&lt;P&gt;Whether you wait for them to be removed or you DV now is your choice. &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Are you going to be applying for anything before their removal date? &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Do you have other items you could be concentrating your effort/time/money on? &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If the answers are no and yes, then I'd put these on the back burner. &lt;/P&gt;</description>
