Collections-Company now out of buisness. Can i get it removed?

I have a collections from a company that has now folded. I originally setteled the account with the hospital. The collection agency is showing settled paid. But the original collector a hospital has now folded. Can i get this item removed from my credit report?

You say that you settled with the hospital, but that the CA is showing settled paid. It is unclear whether both the CA and the OC are showing. Sounds like the CA is definitely showing.

I think that if you paid the hospital, the CA should not be showing on your credit report at all. But if you settled with the CA, then what the CA is showing would be correct.

If what you are saying is that you settled with the CA, and the OC folded, but you want to remove the CA's entry, then your only option is to write good will letters. If you do a search in the search box at the top of the forums for "GW" or "goodwill letter", you'll find lots of examples that you can tailor to your situation.

Since this is a medical collection, I think you should also check the HIPPA threads. However, since you've already paid, they may or may not apply to you.

Just because you paid the OC does not mean a CA can not report. Both are allowed.

Since the HIPPA process is for paid medical collections, use the HIPPA process.

I settled with the CA. I paid them. But the hospital who I owed the money to Pendleton Memorial went out of business after Hurricane Katrina. I would do the HIPAA process but the hospital is no longer there. They went bankrupt.

Do I have to deal directly with the CA? Is there any chance they would delete the record?

I see that you settled, but is this med collection reporting, a $0 balance?

What do you mean they do not report collections. I had one from a hospital showing as in collections.

How old was it? Who was reporting it? I have only heard of this happening one time. It was for a collection reporting past CRTPs.

It was only last year and the hospital was reporting it, along with a CA.

I have never heard of a hospital reporting as an OC. They would need all kinds of required software of the CBs. and they would have to follow all state and federal laws for credit reporting.

Most hospitals are turning all their billing over to *billing services*. These companies may or may not be in the same state. But they can not report.

Thanks again. I followed the HIPAA process on two of my accounts where the hospital are still in existence. I am kind of confused on how to proceed when the OC is no longer in business. Will it be okay for me to contact the CRA directly?

First send the dispute letter. Be sure to hand write it or use colored paper & italics. Wait for the dispute to be completed.

If it isn't deleted then go to SCENARIO # 2. This is sent to the CA.
