I'm wondering if you have a collection account on your CRA that should not be reported according to the National Consumer Assistance Plan do you file a dispute or are the CRA and collection agencies responsible for reviewing these accounts and having them deleted.

The "National Consumer Assistance Plan" is actually a summary of the procedures agreed to the CRAs to comply with the Jan 2015 agreement reached between the big-3 CRAs and the AGs of several states.

The collection reporting provisions apply to collections on debts that are not based on any agreement entered into by a consumer, such as fines and tickets, and to debts under collection that have been paid by medical insurance. The reporting is not inaccurate, and thus the dispute process does not technically apply. Removal is based entirely upon consent of the CRA, and is not based on any requirment of statute or regulation.

If your collection is based on either of those scenarios, contact the CRA and request administrative removal based on the Assistance Plan.

Will the CRA be able to tell what type of collection it is so they will be able to delete without contacting the collection agency. Also, when I call the CRA and make the request for administrative removal will the representatives know what I'm talking about.

If the rep is not aware of the Plan, ask for a supervisor.

They will likely be able to tell whether the collection qualifies based on reported info, but may have to contact the furnisher for more info. It depends......

Does the National Consumer Assistance Plan apply to all 50 states and DC or just the 31 states that their AG signed off on.
