Thanks for the response sidewinder - wow, some very knowledgeable people here!

I figured out the address issue - it's for a card on which I was an AU. I'm not an AU any longer on that card but it's still showing up on my CR which helps my utilization tremendously. I'll be leaving that one alone!

So, ideally, I should have sent my info to the CA instead of the CRA? (Since I'm in no particular rush, this is not a crisis. I'll just look at it as a lesson learned.)Strange that a letter from the Original Creditor would carry less weight than what the CA has to say. I suppose I could have forged a letter from the OC though.

Errrr...did I make a mistake in not sending it CMRRR? For some reason, I thought that was more important when dealing with the CA.

Sounds like I should fax my info over to the person I spoke to at the CA this morning - even though I have sent the info to Experian? Chopbrocoli had recommended that originally but when the lady from the CA told me it would be faster through Experian, I did that instead. (ah, another lesson learned)

I had a parking ticket a few years ago which I wound up going to court over it and the judge said I was right and 86'd it. So I don't owe it - yeah me - vindicated.

(Note to self: just pay the stupid thing - it's sooo not worth the hassle.)

But the whole process took a long time and it was sent to collections as all this went on. So even though I don't have to pay the ticket,I pulled Experian and there it is!

 status: paid in settlement/collection account

creditor's statement: account legally paid in full for less than full balance

Very new to all this - what do I do? Do I DV the collection agency, Allied International?

Oh, one more thing, is it worth it to correct an address? Exp has me at the correct address now but they also have listed a relative's address for my previous address - I never lived there. Ignore or fix?

If the judge says you didn't owe anything, then what you should do is have the court document in writing and fax it to the CA. Since they are the data furnisher, request that they delete the TL off your reports. If they do not, then they are reporting inaccurate information on your CR and in violation.

As for the addresses, personally I like to have accurate addresses reporting. One reason is in case I want to apply for credit in the future and the creditor asks me security verification questions from my CR, I will be able to answer it and verify my previous address, county, etc.

I called the court to get something in writing from them. The helpful / hopefully knowlegeable guy in the collections dept looked up the citation, confirmed that there should be no collections action on it and had me fax him the part of my CR showing the collection item and a copy of my driver's license.

He said they could clear it up from their end in 2-3 days but suggested that I dispute with Experian because his personal experience was that collection agencies were so slow to update. He even gave me his direct line in case I needed to followup with him. (very nice)

I'm thinking to wait a week, let him process anything he needs to from his end and then dispute with Experian.

Is that any better/worse than going directly to the CA (as suggested above)? Chopbrocoli, was there a reason to go to the CA with the issue or is disputing with Experian going to be just as good?

Reason is because the CA is the one that can change or delete your account information in a matter of seconds. All they would need to do is: Type in your SS#, address, enter a 3 digit code, click submit, and voila The request for deletion is successful. Then 3 days later, the TL should be off your reports. For your situation, this would be a much faster alternative than typing up a letter, providing documents, and wating for up to a month.

The letter from the OC is on the way to me. I googled the CA, Allied International Credit, and have a fax number. Can I just fax it to them or do I need to send it CMRRR? I looked for a sample letter but didn't find one that fit my situation. Check this....

Dear 'annoying collection agency',

My credit report shows a debt from 'local city court' as reported by your agency. Attached please see the letter from 'local city court' documenting that I do not owe this debt. Please delete this from my credit report. Failure to do so will mean you are reporting inaccurate information on and in violation.

Thank you very much, me.

It seems too easy for 'annoying collection agency' to ignore my polite fax. Is there anything else I should do?

In addition to my cover sheet and letter from 'local city court', should I include a copy of the info from my CR?

Message Edited by pjohnston2 on 02-21-2009 08:14 PM

Message Edited by pjohnston2 on 02-21-2009 08:15 PM

Send your letter to the CA, only take out "Please" and add "Immediately" delete this from my credit report(s). I personally would send CM so that I at least know they got it and when. Don't include the info from your CR. Just your name, the account number and the amount of the collection. I personnaly would also send the CRA the same info under another cover letter from you. That way if the CA is slow to delete it, the CRA will be a backup.

ok, changes made.

I'm hoping this won't be a big hairy deal getting them to remove it once I submit the letter from the OC.

You would have a fax confirmation sheet for proof. You could do both and notate on the fax cover sheet that the document is also being CMRRR. I would add that to the actual letter too. Include the CM tracking number on your letter. It it usually best to send CMRRR for tracking purposes, you know when it was actually received (versus sitting on a fax machine for how who knows how long?), and when you can actually read the name of the signer you can say so and so signed for it on such and such date. Just more verification with the CMRRR in my opinion.

update and new question:

I got a call from the HQ of the CA regarding a voicemail I left about my issue. That was the main office and she is ready to help! She told me the guy in the Phx office probably doesn't know HOW to do this. (I clearly was not going to get anywhere with him.)

So, here is the sitation now: she has asked that I fax my info to her directly and she will take care of it. She did warn me that it could take 30-90days. I asked if disputing with Experian was any faster and she said it actually would be. She said calling Experian and faxing the info over to them would have this resolved much quicker.

Is there a number to call Experian? I have done a search on the myfico boards but you can imagine how many threads have the word Experian in them.

BTW: the guy in the local Phx office was a stonewall - didn't know how to accomplish this so told me it couldn't be done. reinforces that you need to get in touch with the RIGHT person. The lady from the HQ was responsive, professional and friendly.

Thanks!

Disputes can take 30-45 days.

Do not be shocked if you get a response of "verified". As this letter came from the OC, not the company reporting, and usually the CRA will see that as "invalid evidence".

However, when they process the dispute, if the CA responds with "delete", then you'll be ok. But that bad thing is most disputes are handled automatically through computers, so an actual person at the CA may not actually know you are disputing or know your situation.

If it does come back verified, I would send the paper work to the CA as asked and let them submit a delete. All CA's will tell you it takes 30-90 days because that is the amount of time that a CRA has to update their files.

In all reality, a dispute usually takes longer to get something removed than it would take if the CA submitted a request for removal.

As for the other address..if you've never lived there, you need to do some background and find out why this address is on your report.

Check the "address identificiation number" and check each account reporting and make sure no creditors are reporting. If they are, find out why.

I would then have the address removed and watch my reports closely. Are there any inquiries you do not recognize as being yours?

just an update:

I sent the ppwk, including letter from the OC, to Experian. They sent me an email that said it had been verified. Grrrr.

I called back the the very nice helpful woman at the CA, told her I had no joy via disputing with Experian. Faxed over the docs to her.

Magic happened.

When I ran my CCT today, my FAKO for Experian went from 701 yesterday to 771 today.

what I learned -

check your credit report regularly because there may be errors.

when a very knowledgable person on myfico.com tells you to send the info to the CA, don't be swayed by the CA into disputing it with the CRA as a faster way. they know what they're talking about here.

not everyone at CAs are horrible terrible and incompetent

Thanks all!
