Hello All,

After reading some of the posts about First Premier successful deletion, I decided to come up with a way to try and tackle them after many failed attempts. I compared my reports and there is indeed contradicting information on my reports. The account is charged off, however, one report had DOFD as 10/10 and another report as 9/11. The charge off dates were off as well with one report being 9/13 and the other being 10/11. I came across some successful emails that others had sent out, so I compiled one yesterday to fit my situation and sent it. Realistically, do you guys think I have a chance at getting this account removed or will FP likely just update the info to read the same? I'm really hoping that I can be done with them once and for all? For those of you who emailed FP and had a successful delete, how long did it take to get an actual response from them? I emailed them on the 1/9, got an email the next day asking for my address. A week later which was yesterday i got this.

This letter is in response to the correspondence we received from you on January 9, 2017. You expressed concern regarding how the account is reporting to the consumer reporting agencies and requested the account be removed from your report.

This account was opened in April 2010. The last payment received was $100.00 in July 2010. The account charged off in December 2010 with a balance of $453.39, which remains the balance today. A charged off account normally remains on the cardholder’s credit report for seven years.

Due to the time that has passed, we sent a request to the consumer reporting agencies to remove the account from your credit report. Please allow approximately one week for the update.

We apologize for any inconvenience this may have caused.

Thank you so much! Glad to hear everything worked out well for you. I am too hoping for the same results, however, i did not directly ask for the account to be deleted. I asked them to verify all of the info that was being reported and to send me copies of statement history, transactions, etc. We shall see!

I just received an email requesting that I send them my updated address. Not sure what that means but I did indeed update it with them.

Could you PM the specific email that you used for this? I have sent emails before about difference in disputing but they just come back as verified...

A dispute over specific information, such as relevant date of a DOFD, only requires verification, correction, or deletion of that specific item of information.

Finding an inaccuracy in reporting is not basis for having other information, such as reporting of a CO, deleted, or having the entire account deleted.

There is always the possibility that any creditor will choose to delete their entire account as a way to resolve a dispute, as deletion removes any controversy over accuracy of reporting. However, if the question is whether a dispute of accuracy of any information results in a requirement to delete information that is not shown to be inaccurate, the answer is no.

Ok I received a packet from First Premier. I requested all of the information pertaining to my account. They responded by only sending me the history for the last 9 months of the account even though it was open from 2008-2011. They stated that they are not obligated to send me the information for the entire time period. They also stated that DOFD is only counted from the time an account becomes delinquent and is never caught up to current. What are your thoughts on how I should address this response? I thought DOFD was from whatever date the account first became delinquent for 30 days or more. Also, how can they not give me the information for the 3 previous years and only say 9 months is all I get?

i decided to give them a try in order to rebuild my credit OMG what a disaster.......my score went down over 70 points and now that they have reported my utilization less than 30% my score only increased by 7 points. what to do?

Debt validation only applies to debt collectors, not original creditors.

Creditors provide an initial account agreement, and thereafter provide billing statements. Those comprise ongoing verification of the debt and account information.

The consumer is responsible for retention of those records.

DOFD is defined under FCRA 605(c) as the date of first delinquency that immediately preceded the charge-off.

Stating differently, it is not necessarily the first delinquency on the account, it is the first delinquency in the most recent chain of delinquency.

Bringing an account back into good-standing prior to a charge-off results in setting of a new DOFD if/when the account again becomes delinquent.

As for date of charge-off, a creditor does not actually report the date they did that accounting measure. REporting of a CO only means that they are reporting that they took that measure at some prior point in time. It is thus not improper or inaccurate for the date of reporting of a CO to vary between the different CRAs.

The significance of the reporting date is that the DOFD must then, by definition, be prior to, and not after, that date.

The DOFD is the significant date that should be the same with each CRA.

Those of you asking for the email to pm didn't read the response. The reason for the removal is because the dofd has been almost 7 years - just a few months shy. That is why it has been removed. The majority of default accounts are removed at the 6 yr 9 month mark. It is highly possible this was handled similar to an early exclusion. The account would likely have been removed even without the email.

I am not saying don't contact them. I am saying don't expect the same results unless it has been close to 7 years your account defaulted.
