Hello all,

Thanks in advance for taking the time to read this question.

I have a legal item filed and pain in Dec of '10 resulting from neglegent use of a Capital One card in the past. If I knew then what I know now I would have attempted a PFD but hindsight is 20/20. My question is, is there any recourse I can take to have these removed or do I just need to wait for them to stop reporting?

I appreciate any input you can give.

Thanks!

I would wait until after July 1 to see if it remains. After that, if it's still there, start requesting early exclusion from the bureau's. TU will usually be the first to grant it at 6 months out. I think Experian is 2-3 months and Equifax is 1 month early.

Dont fret you lack of offering a prior PFD.

You cannot PFD on a judgment, as only the court can vacate its own judgment.

Judgements are not reported by the prevailing plaintiff, they are entered into your credit report via CRA review of public records.

In paying a judgment, the prevailing plaintiff cannot agree to deletion of the public record posting of the judgment.

If the judgment was paid in 12/2010, it reaches its requried exclusion date in 12/2017.

It is now within 6 months of exclusion, so you can now attempt an early exclusion request from the CRA.

Thus, if not removed by the CRA in July under their National Consumer Assistance Plan, it will nonetheless soon be history.
