The FCRA anticipates your situation by including a requirement that ensures a consumer should not have to guess as to whether the resolution of a dispute has removed or corrected information from their credit file/report.

More specifically, FCRA 611(a)(6)(B)(ii) requires that a Notice of Results of Reinvestigation (which is the formal CRA document that provides the resolution of a dispute) must include "a consumer report that is based upon the consumer's file as that file is revised as a result of the reinvestigation."

If their Notice of REsults did not include a copy of your revised credit report showing that the CRA has actually made the changes to your credit file, then the Notice is not in compliance with section 611(a)(6)(B)(ii). You can formally or informally contact the CRA requesting a free copy of your credit report evidencing the entry of any changes that resulted from your dispute.

If they fail to comply, you can file a civil action against the CRA, and/or a formal complaint with the CFPB.

I recently received dispute results from TU in regards to a 90 day Fedloan Servicing late payment that was applied while I was in forbearance. I sent all of the CRAs the official letter stating that I was in forbearance (an actual forbearance not placed retroactively) and received the following results for the accounts: "disputed information updated and other information updated". Does this mean that the 90 day lates were removed? Should I call TU and get clarification on this?

Thank you for your response. I should have stated that the attached credit report from TU still shows the 90 day late payment and states "dispute investigation complete - reported by granter; account in forbearance". However TU's investigation states that the information was updated. I will be contacting TU because this 90 day late payment should have been removed.
