Ok, now I'm thoroughly confused.

I know that the SOL is the timeframe from DOFD that a company can sue someone for payment. Well, I've got several collections that are anywhere from 4-5 years over SOL if I'm reading the SC SOL correctly.

I think for medical bills the SOL in SC is 3 years. So, if this is the case, how can I use this to my advantage to get these collections off of my credit report?

Several have been paid per the report, several have not. However, all of them are past SOL even if they aren't based on the DOS.

Are medical collections considered "written contract"(10) or an "open account" (3) in SC? I haven't found anything that is specific to the SOL on medical collections.

Message Edited by Bran9192 on 05-27-2008 05:45 AM

From what I understand, "open" accounts are primarily revolving accounts like credit cards ...

If SOL is up, and it wasn't re-aged, the collections can still be on your CR up to the 7-7.5 yr time limit.

Edit to add.....there's not too much you can do to get them removed, if unpaid. About the only thing you can do is either wait the full 7 yrs from DOFD or offer a PFD. Another option would be to use a violation and hang that over their head to get them to delete (e.g. illegal re-aging, FDCPA violations, HIPAA violations).

Message Edited by llecs on 05-27-2008 09:18 AM

Wonderin,

Thats exactly what I was thinking since you do have to fill out paperwork almost everytime you go to the Doctor and every visit to a hospital requries paperwork be filled out.
