I’ve been battling with Affirm to have a late payment that’s being reported removed from Experian, I dispute it being valid but it’s fallen on deaf ears with Affirm and Experian. What is a person supposed to do in this situation? I submitted a complaint with the BBB, so far have got an initial response and issued a rebuttal but been waiting 21+ days for the businesses response.

Any suggestions or way I may be able to tackle this is greatly appreciated.

Essentially what occurred is my recurring payment method was denied for Affirm, or so Affirm claims. On checking I have no record of an attempted or returned charge, and never received notification of the failure of the payment by text, email, or phone. Once it was discovered the payment was missed I made payment immediately, which wasn’t discovered until I logged into the account to check what was left on the balance.

Notably this was my 2nd account with Affirm, and the 1st account was paid w/o any missed payments. Think this was the 4th of 6 payments. If you need anymore info please let me know. Thank you for any feedback or help.

I’ve looked and haven’t been able to find her or another executives contact information which is weird google is usually my friend lol. So far all I’ve done is contact CSR’s, supervisor, and out of desperation filed the BBB complaint. I know you cannot share the email but can you suggest a term to search to find her email address on Google?

I wish I had known that about their reputation then, made many strides in fixing my credit but this is holding back my EX score and unjustly so. So far the BBB complaint has been responded to initially by normal CSR’s which in and of itself is crazy. The rebuttal and declined response is still pending a response from them. Thanks again HiiiPower for your help and any info you can provide.

Have you asked for a letter from your bank stating they did not attempt to draft your account? If your bank provides you with one , you can dispute/file complaint with that.

If they really did not attempt to draft your account, you can base your complaint on the fact they are manufacturing fees for imaginary late payments.

So I’ve now submitted my 3rd rebuttal through BBB because all emails have been ignored with email addresses I was able to find.

Essentially I made the down payment was not given a due date which is even disclosed in the truth in lending disclosure they provided at loan signing that I would be notified of said due date. Affirm attests they emailed and texted it to me, I argue their policy states they can also send it by postal mail, call, or call anyone I may know.

I never received the notices of the due date, nor the fact the payment wasn’t processed due to going through a separation (having to get a new phone, transfer my number, and countless other things) despite having a pristine payment history on a previous loan Affirm only used 2 of 5 available methods to contact me to notify me of the loan due date or when the account fell past due by 30 days. Then let the account sit as last reporting as 30 days late until January 24th from June 10th despite the account being brought current and through regular payments paid off on October 10th. The only reason it was updated on January 24th is because I found it wasn’t reporting correctly and asked for removal of the account and late payment as such. Instead they simply updated their reporting. When I attested it was unfair and unaccurate reporting for over 6 months they attested it was the result of a “delay”.

Anyone got any advice? I’m at my wits ends with these people.

Once you have filed a dispute of the accuracy of their reporting and obtained verification if its accuracy, you then obtain the right under FCRA 623(c) to file a private civil action and receive judicial review of the asserted facts.

Yes, it is prudent to first attempt informal contact and resolution, but if that has failed and you need to take formal action, I would recomment filing a civil complaint.

You can also file a complaint with the CFPB, which will usually, if the lendor falls under CFPB jurisdiction (i.e., $10B or more of assets), will result in an inquiry letter from the CFPB, but that may not result in the lendor changing their position, and the CFPB will usually not initiate its own civil action on your behalf.
