The implementing rules for the direct dispute process, set forth in 16 CFR 660.4(b)(i), specifically exempts consumer identifying information, such as name, DOB, SSN, and addresses, as well as public record information and credit inquiries, from the direct dispute process.

The CRA dispute process, however, as defined under FCRA 611, permits disputes relating to "any item of information" of record in the consumer's credit file, and does not exempt any specific types of information.

If you are disputing the accuracy of personal identification information, such as addresses, you cannot use the direct dispute process, and MUST use the CRA dispute process.

Could someone give me the correct address for disputing with NCC? I tried to disputing with him about a year ago at the 3733 University Blvd. address and my green card kicked back to me saying address unknown. That’s also how they are reporting their address on my credit report. However, online I’m seeing 9428 Baymeadows Suite 200. Which one is correct or has anyone been successful with?

If you wish to file a direct dispute with the furnisher as opposed to disputing via a CRA, then the implementing regulations for the direct dispute process include a section governing the direct dispute address:

"16 CFR 660.4(c) Direct dispute address.

A furnisher is required to investigate a direct dispute only if a consumer submits a dispute notice to the furnisher at:

(1) The address of a furnisher provided by a furnisher and set forth on a consumer report relating to the consumer;

(2) An address clearly and conspicuously specified by the furnisher for submitting direct disputes that is provided to the consumer in writing or electronically (if the consumer has agreed to the electronic delivery of information from the furnisher); or

(3) Any business address of the furnisher if the furnisher has not so specified and provided an address for submitting direct disputes under paragraphs (c)(1) or (2) of this section."

Thanks for the two reply’s- wouldn’t it be a better idea to dispute with the CRA? I’d think that NCC would just update the info or something of that nature. I do have screen shots of how NCC is listing that wrong address on my reports and of the envelope with the “ No such street, return to sender “ label on it, including my green card that was still attached. It’s been listed this way for years.

The advantage to filing a direct dispute with the furnisher is that it insures that ALL information and arguments supporting your dispute are received by the furnisher.

When you file a dispute via the CRA, the CRA is then required to send a copy of the dispute along with all relevant information provided by the consumre to the furnsher, which is usually done via their automated e-Oscar system.

There is a long history of the CRAs not sending all information provided by the consumer, and thus the furnisher not getting all documentation and arguments.

A direct dispute bypasses any concerns over what a CRA might send to the furnisher.

The CFPB has tightened its review of the CRA e-Oscar process, and the CRAs have, in the past two years, agreed to send all information to furnishers, so the situation has vastly improved. It is now likely that most, if not all, of your supporting documentation will be sent to the furnisher.

The legal advantage of disputing via a CRA rather than using the direct dispute process is that a consumer has no right to file and civil action regarding disputes over accuracy of reported information until they have first filed a dispute via a CRA. See FCRA 623(c).

Thus, in the event that the furnisher verifies the accuracy of the reported information and you then wish to escalate by getting review by the courts, you MUST have filed the dispute via the CRA.

What, specifically, is the inaccuracy in their reporting that you are disputing?

If the reason for pursuing a dispute is an attempt to get the entire collection deleted, a dispute only relates to the specific item of information that is identified in the disute as being inaccurate.

Unless your dispute is contesting the validity of the debt itself, then disputing something under a collection will only require verification, correction, or if neither can be done, deletion of that specific item of information.

It wont require deletion of the collection per se.

I was going to dispute inaccurate info listed by them as contact info for disputes on my credit report. The CRA in question has, apparently, the wrong or an old address that was causing my disputes to the CA to come back to be undelivered. I have examples that i have saved, plus copies of how the info is being listed in my actual credit report.
