      <description>&lt;P&gt;There are two separate and essentially unrelated paths you can pursue to attempt to get fraudulent/identity theft information removed from your credit report.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;First is to file a dispute with the CRA, and get the matter investigated and a either deleted or verified by the dispute process.&lt;/P&gt;&lt;P&gt;Second it to send the CRA a request to block the information under the identity theft process provisions of FCRA 609B.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It is common for a dispute contesting the showing of identity theft related information to be verified, as the creditor can rely upon documents in its possession to verify the reporting.&lt;/P&gt;&lt;P&gt;For that reason, congress amended the FCRA back in the 1990's by addtion of the identity theft process under FCRA 609B.&lt;/P&gt;&lt;P&gt;That process removes the creditor or any issue of verification from the process by permitting block of the information if the consumer sends the CRA a sworn statement in the form of a police report that provides an assertion that the consumer never authorized the account.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If the prior contact with the CRA was a formal dispute under FCRA 611, even though it included a police report as part of the dispute, it was not clearly a request to block the information under the identity theft process of FCRA 609B.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I would recommend sending a clear request to block, citing FCRA 609B and accompanied by a copy of the police report.&lt;/P&gt;&lt;P&gt;That request to block is then not subject to investigation and verification of accuracy, and if the CRA then refuses to block under the requirments of section 609B, then you have a violation on the part of the CRA that could be pursued either by formal dispute with the CFPB or civil action against the CRA.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>
