topic Why does FICO mark an acount 90+ days late when it was included in a BK and never late? in Rebuilding Your Credit

HI everyone,

I have see a couple of posts around the same similar topic. It seems that I have 5 accounts that were included in a BK in 12/2016. TU, EQ and EX all report these accounts. However, FICO is seeing everyone of these accounts with a derogatory remark under the EX report and marking it as 90+ days/other derog remark. When pulling my score and FICO reports, its showing 5 accounts with recent serious delinquent or missed payments. WHen applying for credit, i got the infamous letter 7-10 days later and the reason was "too many accounts with recently missed payments". I never missed ANY payments. I made every payment on every account up until the BK.

So why does these get grouped together? FICO scores are based on different criteria, one of which is payment history. Do they consider a BK date as a missed payment?

I am still also fighting with EX because 4 out of the 5 accounts are still incorrect and although I have disputed these, EX is now telling me I cannot dispute them again. One account shows the account as Charge Off on 10/2017 when the account was included in a 12/2016 BK. The other 3 show C/O 11/2016 although they were not charged off and were included in the 12/2016 BK and were paid never late with the remark "included in bankruptcy/never late".

EX tells me on their website I now have to call them and discuss it. Everytime i call them I get someone who has NO idea what they are doing and they just waste my time and frustrate me. This is usually after waiting an hour or more on hold to talk to them.

Has anyone else ever had issues where FICO is reporting missed payments when there are no missed payments? I have bank statements proving this and the credit grantors already also said "Never Late" in their remarks.

I see you asked the same thing here: https://ficoforums.myfico.com/t5/Bankruptcy/FICO-REPORTING-LATE-PAYMENTS-AFTER-BANKRUPTCY-DISCHARGE/m-p/5738333#M66741

Best advice is take your credit reports and hand them over to your lawyer. They can get it fixed. If it is a violaton they can go after the creditors and you could be rewarded $1000 plus court/lawyer fees for violating the BK laws. The creditors tell FICO what to post and they make the score only. Least they should correctly. And you can file a complaint with the CFPB. If the late dates are 1 day after the file date. Thats all you need to persue further action.
