@Anonymous wrote:

I have a medical collection with Savit Collection for ~$500. I requested to pay in full for deletion. They replied with a letter denying my request but also provided detailed paperwork from the hospital which clearly stated my diagnosis & procedures performed. Isn't that a Hipaa violation as I didn't approve my medical information be released to them? And if so, what do you advise as my next steps?

No, it is not a HIPAA violation. As long as the CA has an active business relationship with the provider they can request supporting documentation in what ever form when a consumer disputes an account. You actually DID approve releasing your information under this circumstance. When you signed the consent(s) for treatment which includes a Financial Guarantee there is ALWAYS a paragraph in there about what they can and will do if the account goes to collections and that by signing you agree. That includes releasing information to their assigned CA to handle the account including disputes. The problem is 99.6% don't read the form they just sign it.

And if so, what do you advise as my next steps?

Releasing the diagnosis is a violation, detailed billing is not. Here are your options to get rid of the entry on your CR. You might also want to consult a consumer credit attorney on this.

https://legalbeagle.com/5679447-collection-agencies-hipaa-laws.html

1. Call the OC and see if insurance can be billed, (or-rebilled), collections ultimately paid by insurance get removed per new rules that came from CRAs settlement with 22 state AGs. If not then
2. see if you qualify for Charity Care, if not then
3. ask that they recall the collection in exchange for full payment
4. Send the reporting CA a PFD offer
5. Google the HIPAA Process and contact its creator for help, this process cannot be discussed in any forum of myFico.
