    <description>&lt;P&gt;Coold the account have been sold to the other company?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Get the CA to send you a letter in the mail, this will sefve as your dunning letter, you can DV from there, I love this part, when you get the validation back from them IF they even validate (which would be about right, rain on my parade lol) send them a FOAD letter, even though it is not your debt.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Dear idiot,&lt;/P&gt;&lt;P&gt;you are trying to collect on a debt that is not nor never has been mine and further more educate yourself on the statue of limitaions for debt collection this is past the sol and shame on your for trying to pull a fast one on the real person this debt belongs to which is NOT ME. SEE YA!!!!!!!!!!!!&lt;/P&gt;</description>

      <description>&lt;P&gt;I have a similar situation and they are sending it from NCO as the holder of the "debt" via a company called ALW sourcing.&amp;nbsp; I traced the original bank the card came from and I never had this account.&amp;nbsp; The bank told me to file a fraud notice to the collection agency. It was removed from my trade lines in 2007, the debt they claim is from 1993!&amp;nbsp; Are there any sample letters to show me what I need to say in the fraud alert and to tell them to cease and desist?&amp;nbsp; I don't want this showing up on my credit report again and don't think it should be possible.       <description>&lt;P&gt;I called the original company and the record of the debt they have is invalid.&lt;/P&gt;&lt;P&gt;They removed it from the credit report.&lt;/P&gt;&lt;P&gt;But sold the debt, depsite it not being correct.&lt;/P&gt;&lt;P&gt;I want the debt collector for this to stop calling and to stop mailing me.&lt;/P&gt;&lt;P&gt;I did not see this on my current fico.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What do I do now? Is there a sample letter that will show me how to do this correctly? I have a general idea, but I don't want to be harassed about something that isn't mine, nor do I want it to bring down my credit score while I'm shopping for a house.&lt;/P&gt;</description>

      <description>&lt;P&gt;It sounds like you have this CA contacting you trying to collect, but they are not reporting your reports? &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It also sounds like the debt is valid, but very old, is this right? &lt;/P&gt;</description>

      <description>&lt;P&gt;When I pulled myfico scores from here, it is not listed.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I called the bank, the only record they have is they say it is an Avenue store charge account. I never had this charge account. I had a Lane Bryant account that was handled, but never this one. They don't have any other paper on this Avenue account, which they report has been sold twice.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;So, yes they are trying to collect a debt that is not mine.&amp;nbsp; And I don't know how to see if it is on my credit report. The bank says it was removed from the tradeline and gave me the date, like 2007, but I saw it on a tri-merge report in 2008 and disputed it again then.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;What should I do now? Sorry, but I'm confused and buying a home...don't want this holding me back.&lt;/P&gt;</description>

      <description>So, here's the update.&amp;nbsp; I sent the letter to the owner of the copany ALW Sourcing and now the parent company NCO is calling again, stating that they never rec'd the letter. They are also telling me that they pulled an inquiry from TU!&amp;nbsp; What does this mean?&amp;nbsp; Will this count against me?&amp;nbsp; I thought I solved this by putting a block on inquiries that weren't my own. They are trying to tell me that I need to fill out a form with them to dispute the debt. I told them I wouldn't do that. They also said they would put me on cease and desist until they rec'd the letter. I informed them that I would call the NYS AGs office. What should I do now? They want another letter certified in the mail. I'm not going to keep sending out these expensive letters so they can keep passing something around.&amp;nbsp; Besides what is the sol date on the things that are valid? They were trying to collect on the fradulent account, but now they are talking about a Sears bill (was valid) from 15 years ago!&amp;nbsp; HELP!</description>

If you have moved states, you need to read the statutes for the state the account was opened in/defaulted in and your current state. &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;On the account not yours........they are only contacting you but not reporting-- right? When do they claim this debt is from? Is from far enough back that they can't report?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As for the inquiry, pull your report directly from TU...is it showing? Is it a hard or soft inquiry?&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>I'm in NY. Where do I look for that information? She kept claiming that she could contact me on this debt, because I live in NYS.&amp;nbsp; The debt that wasn't mine was removed from tradelines (all 3) March 2007. I called the original bank who was claiming it. The Sears card was from 1993 or prior.&amp;nbsp; I looked at the Cert letter I sent to them, and I was told to send it to their main company ALW Sourcing, LLC.&amp;nbsp; But the company calling me now, NCO is a subsidiary of them.&amp;nbsp; Where do I look for more of this information to help protect me. I believe that I put a block on unneccassary credit checks...or inquiries, once before, then they stopped.</description>

      <description>&lt;P&gt;Check the "state resources" thread for state statutes. &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The Sears card was opened or defaulted in 1993?&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I don't think you can block inquiries from a CA.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Unless you have proof of sending a cease and desist....they can contact/try to collect forever..doesn't matter where you are.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;The only time limits are on how long they can report and how long they have to recover damages in court. &lt;/P&gt;</description>

      <description>&lt;P&gt;Not unless there is some state statute preventing them. Nothing in FCRA/FDCPA prevents them from attempting to collect unless you send a cease and desist. Then they can't contact you any longer. &lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Otherwise, they can attempt to collect for the next 50 years if they see fit. &lt;/P&gt;</description>
