Okay, so I finally got around to checking out the state resources sticky at the top of the board. I live in TX and I have read the statutes that require 3rd-party collection agencies to maintain current surety bond with the Sec of State. This prompted me to check the status of all of my CA's. HALF OF THEM HAVE NO CURRENT SURETY BOND ON FILE!!! Some are cancelled or pending cancellation and others never had one. What the heck??

I was planning on PFD'ing them next month butnow I don't know what to do being that the state statutes is as follows:

Sec.A392.101.AABOND REQUIREMENT.A (a)A third-party debt
collector or credit bureau may not engage in debt collection unless
the third-party debt collector or credit bureau has obtained a
surety bond issued by a surety company authorized to do business in
this state as prescribed by this section. A copy of the bond must be
filed with the secretary of state.

Should I still PFD? Dispute? What gives experts??

After reading this, I looked up the CA on my husband's file and it show s"expired". What does this really mean?

In some states, as long as the parent company is bonded, it is ok. So, check that.

Also, try to get something from SoS stating they are not bonded. I believe if you contact the SoS, they will respond letting you know if they are bonded or not.

You want to make double sure they are not bonded.

Them not being bonded just means they can't conduct business in your state,you would need to file a complaint, with your AG usually.

Them being bonded has nothing to do with whether you owe the debt or the debt is valid...and failure to bond isn't something the consumer can take action against them for. They are violating state law, so the state would take action if they chose to do so.

I believe the search engine for Texas allows you to search by name, address, or phone number. Try it all ways.
